We\u2019ll explain L.A.\u2019s housing challenges and what you can do to make things better. <\/p>\n<p>A new California law clarifies that landlords \u2014 not tenants \u2014 are responsible for cleaning rental homes covered in debris from disasters, such as the Palisades and Eaton fires that devastated parts of L.A. County earlier this year.<\/p>\n<p>On Friday, Gov. Gavin Newsom signed <a class=\"Link\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202520260SB610\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">Senate Bill 610<\/a>, which stipulates that when natural disasters cause damage to rental housing, \u201cit shall be the duty of a landlord\u201d to remove \u201chazards arising from the disaster, including, but not limited to, the presence of mold, smoke, smoke residue, smoke odor, ash, asbestos or water damage.\u201d<\/p>\n<p>The law addresses the confusion many renters grappling with the aftermath of the January fires have faced. Many apartments were left standing but choked with toxic ash. Some landlords refused to clean the debris, leaving <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/los-angeles-fires-rental-housing-smoke-damage-repairs-tenant-landlord-pasadena\" data-cms-ai=\"0\" rel=\"nofollow noopener\" target=\"_blank\">tenants unable to return home<\/a>.<\/p>\n<p>In the months since the fires, some local officials gave unclear or non-committal <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/los-angeles-city-housing-landlord-tenant-palisades-fire-ash-smoke-remediation-clean-up\" data-cms-ai=\"0\" rel=\"nofollow noopener\" target=\"_blank\">answers about tenants\u2019 rights<\/a> and landlords\u2019 clean-up responsibilities.<\/p>\n<p>LAist reporting informed push for legislative change<\/p>\n<p>State Sen. Sasha Ren\u00e9e P\u00e9rez, a Democrat representing a district that includes Pasadena and Altadena, said the legislation she introduced was driven by tenant complaints her office received, as well as <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/los-angeles-fires-rental-housing-smoke-damage-repairs-tenant-landlord-pasadena\" data-cms-ai=\"0\" rel=\"nofollow noopener\" target=\"_blank\">LAist\u2019s reporting<\/a> on the lack of clarity over clean-up procedures in rental housing.<\/p>\n<p>\u201cThe reporting that you all had done over at LAist was also really helpful,\u201d P\u00e9rez said. \u201cWe&#8217;re hearing directly from constituents and have heard all of these concerns. And here&#8217;s reporting from journalists in the Los Angeles area to further support these claims that I\u2019m making that this is a major issue.\u201d<\/p>\n<p>An <a class=\"Link\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billAnalysisClient.xhtml?bill_id=202520260SB610\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">analysis<\/a> of the bill presented to the Senate Judiciary Committee <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/los-angeles-fires-rental-housing-smoke-damage-repairs-tenant-landlord-pasadena\" data-cms-ai=\"0\" rel=\"nofollow noopener\" target=\"_blank\">cited stories<\/a> by <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/los-angeles-city-housing-landlord-tenant-palisades-fire-ash-smoke-remediation-clean-up\" data-cms-ai=\"0\" rel=\"nofollow noopener\" target=\"_blank\">LAist<\/a> and <a class=\"Link\" href=\"https:\/\/www.latimes.com\/california\/story\/2025-03-20\/altadena-tenants-live-in-eaton-fire-burn-zone\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">reporting from the Los Angeles Times<\/a> to show that existing law had left tenants confused about how to get their homes cleaned.<\/p>\n<p>The backstory<\/p>\n<p>Last month, L.A. County <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/los-angeles-eaton-fire-county-public-health-ash-smoke-toxic-cleanup-lawsuit-settlement\" data-cms-ai=\"0\" rel=\"nofollow noopener\" target=\"_blank\">settled a lawsuit<\/a> brought by tenants in Altadena who alleged that county public health officials had failed to protect tenants dealing with post-fire damage to rental homes. The county agreed to enforce cleaning requirements for landlords.<\/p>\n<p>The city of Pasadena is facing <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/los-angeles-county-pasadena-renter-tenant-landlord-lawsuit-smoke-damage-ash-fire\" data-cms-ai=\"0\" rel=\"nofollow noopener\" target=\"_blank\">a similar lawsuit<\/a>.<\/p>\n<p>Shortly after the Eaton Fire, Pasadena health officials told residents that ash spewed into homes was hazardous and should be professionally remediated. But city code inspectors told renters that the presence of ash <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/los-angeles-fires-rental-housing-smoke-damage-repairs-tenant-landlord-pasadena\" data-cms-ai=\"0\" rel=\"nofollow noopener\" target=\"_blank\">did not violate local habitability codes<\/a> because those codes did not explicitly contain the word \u201cash.\u201d<\/p>\n<p>City housing officials told tenants worried about the lack of clean-up that they could sue their landlord.<\/p>\n<p>SB 610 will change how city officials communicate to tenants and landlords around these issues in the future, said Lisa Derderian, Pasadena\u2019s spokesperson.<\/p>\n<p>\u201cThis law makes important changes in the obligations of a landlord to the tenant that will play out in messaging,\u201d Derderian said in an email to LAist. \u201cThe city takes habitability concerns for any cause seriously and inspects accordingly.\u201d<\/p>\n<p>Similar challenges played out in the city of L.A. During a February web meeting, L.A. housing official Robert Galardi <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/los-angeles-city-housing-landlord-tenant-palisades-fire-ash-smoke-remediation-clean-up\" data-cms-ai=\"0\" rel=\"nofollow noopener\" target=\"_blank\">told renters<\/a> they were responsible for cleaning inside their own units, a claim that was contradicted by a housing department spokesperson later that month when LAist asked about the city\u2019s guidance.<\/p>\n<p>In response to LAist\u2019s questions, Housing Department spokesperson Sharon Sandow said \u201clandlords must remediate hazardous ash debris in rental units.\u201d<\/p>\n<p>Clearing up confusion created by gaps in the law<\/p>\n<p>The law also requires landlords to let tenants move back in at their pre-disaster rental rate and mandates that landlords return rental payments for months when tenants were unable to live in the unit.<\/p>\n<p>Landlord groups said most property owners already have taken responsibility for cleaning their rental housing units.<\/p>\n<p>Debra Carlton with the <a class=\"Link\" href=\"https:\/\/caanet.org\/\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">California Apartment Association<\/a> said the new law clarifies but does not broaden the scope of what landlords must do in the wake of a natural disaster. The law makes it clear that landlords will not have to rebuild destroyed properties.<\/p>\n<p>Carlton said the law \u201creaffirms common-sense standards for addressing debris and smoke damage before a unit is reoccupied.\u201d<\/p>\n<p>Tenant advocates said the law\u2019s passage is a victory for tenants who\u2019ve long argued that the responsibility for cleaning rental properties lies with the landlords who own those properties.<\/p>\n<p>Katie Clark \u2014 an organizer with the <a class=\"Link\" href=\"https:\/\/www.altadenatenantsunion.org\/\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">Altadena Tenants Union<\/a>, a group <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/los-angeles-eaton-fire-altadena-tenants-union-housing-rights-organizing\" data-cms-ai=\"0\" rel=\"nofollow noopener\" target=\"_blank\">created in the wake of the Eaton Fire<\/a> \u2014 said SB 610 finally clears up the confusion around this issue.<\/p>\n<p>\u201cThis closes that gap,\u201d Clark said. \u201cThere is no nuance. There is no room for misunderstanding. [Ash] is absolutely now included in habitability questions.\u201d<\/p>\n<p>Some renters already have moved on<\/p>\n<p>The change may be coming too late for some renters. More than 10 months after the fires, one couple told LAist they have given up on returning to their previous home.<\/p>\n<p>    <img decoding=\"async\" class=\"Image\" alt=\"Marah Eakin and Andrew Morgan stand in the bedroom of an Airbnb rental. They said their landlord never agreed to clean the home, despite testing they said they paid for that revealed high levels of lead.<\/p>\n<p>\u201cWe didn&#8217;t see an end in sight,\u201d Eakin said. \u201cFor a while, we were moving every five days, every week, and that was terrible.\u201d<\/p>\n<p>The couple said they and their 7-year-old twins moved nine times before settling down in July with a long-term lease on a home in Altadena. Morgan said the instability was especially tough on their kids.<\/p>\n<p>\u201cWhen they say that they miss the old house, some other old stuff, it&#8217;s just heart-wrenching,\u201d he said.<\/p>\n<p>LAist reached out to the property management company for Eakin and Morgan\u2019s previous Pasadena home but did not get a response.<\/p>\n","protected":false},"excerpt":{"rendered":"Your starter guide to housing development in L.A.
