{"id":82552,"date":"2025-12-05T09:04:13","date_gmt":"2025-12-05T09:04:13","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/82552\/"},"modified":"2025-12-05T09:04:13","modified_gmt":"2025-12-05T09:04:13","slug":"supreme-court-rules-for-texas-republicans-allowing-new-election-map-to-go-into-effect","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/82552\/","title":{"rendered":"Supreme Court rules for Texas Republicans, allowing new election map to go into effect"},"content":{"rendered":"\n<p>WASHINGTON \u00a0\u2014\u00a0The Supreme Court ruled for Texas and its GOP leaders on Thursday, clearing the way for the state to use a <a class=\"link\" href=\"https:\/\/www.latimes.com\/politics\/story\/2025-08-23\/texas-gov-abbott-says-hell-swiftly-sign-new-maps-on-his-desk-that-will-boost-gop-in-2026\" rel=\"nofollow noopener\" target=\"_blank\">new election map in 2026<\/a> that is expected to send five more Republicans to Congress. <\/p>\n<p>The justices set aside, for now, <a class=\"link\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A608\/385468\/20251121185106732_25A%20Appendix%20to%20Emergency%20Application%20for%20Stay.pdf\" target=\"_blank\" rel=\"nofollow noopener\">a 2-1 ruling by district judges<\/a> who called the state\u2019s map a racial gerrymander. Thursday\u2019s vote was 6-3 along the usual lines, with the conservative justices in the majority and the three liberals in dissent. <\/p>\n<p>The court\u2019s five-paragraph order said the district judges \u201cfailed to honor the presumption of legislative good faith by construing ambiguous direct and circumstantial evidence against the legislature.\u201d <\/p>\n<p>\u201cThe impetus for the adoption of the Texas map (like the map subsequently adopted in California) was partisan advantage pure and simple,\u201d wrote Justice Samuel A. Alito Jr. in a concurring opinion.<\/p>\n<p>Texas lawmakers had said they acted out of partisan motives, not racial ones. <\/p>\n<p>\u201cToday\u2019s order disrespects the work of a District Court that did everything one could ask to carry out its charge \u2014 that put aside every consideration except getting the issue before it right,\u201d wrote Justice Elena Kagan in dissent. \u201cAnd today\u2019s order disserves the millions of Texans whom the District Court found were assigned to their new districts based on their race. Because this Court\u2019s precedents and our Constitution demand better, I respectfully dissent.\u201d<\/p>\n<p>She was joined by Justices Sonia Sotomayor and Ketanji Brown Jackson.<\/p>\n<p>The decision bolsters Republicans in their bid to retain control of the House, and it\u2019s a setback for Democrats and voting rights advocates. <\/p>\n<p>It is consistent with the conservative majority\u2019s view that drawing election districts is a \u201cpolitical question\u201d left to state lawmakers, not judges. But in the past, the court also said racial gerrymandering is unconstitutional under the 14th and 15th Amendments.<\/p>\n<p>In response to the Texas mid-decade redistricting, California Gov. Gavin Newsom won  voters\u2019 approval for redrawing his state\u2019s congressional districts with the aim of electing five more Democrats in 2026.<\/p>\n<p>On Nov. 21, Texas state\u2019s attorneys filed an emergency <a class=\"link\" href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/25a608.html\" target=\"_blank\" rel=\"nofollow noopener\">appeal at the Supreme Court,<\/a> urging the justices to act quickly to block the lower court\u2019s ruling. <\/p>\n<p>They argued the new election map for Texas was drawn based on partisan advantage, not the race of the voters. And they said a further delay would disrupt the next election because Dec. 8 is the filing deadline for candidates.<\/p>\n<p>They cited the so-called \u201cPurcell principle\u201d as grounds for setting aside the district court ruling because it came to close to an impending election. <\/p>\n<p>The Texas mid-decade restricting arose in July.<\/p>\n<p>\u201cTexas has also made a strong showing of irreparable harm and that the equities and public interest favor it,\u201d the Supreme Court ruling said. \u201cThis Court has repeatedly emphasized that lower federal courts should ordinarily not alter the election rules on the eve of an election. The District Court violated that rule here.\u201d<\/p>\n<p>Acting at the behest of President Trump, Texas Gov.
