{"id":89070,"date":"2025-12-10T13:03:08","date_gmt":"2025-12-10T13:03:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/89070\/"},"modified":"2025-12-10T13:03:08","modified_gmt":"2025-12-10T13:03:08","slug":"suit-challenges-california-ban-on-less-lethal-pepperball-weapons","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/89070\/","title":{"rendered":"Suit challenges California ban on less-lethal pepperball weapons"},"content":{"rendered":"<p>A newly filed lawsuit in San Diego federal court is challenging the constitutionality of California laws that prohibit state residents from buying and owning weapons that fire pepper projectiles, arguing that banning the less-lethal weapons violates the Second Amendment.<\/p>\n<p>Such weapons are known as pepper projectile launchers and typically resemble a pistol or rifle, using CO\u2082 cartridges to fire pepperballs, which are about the size of paintballs and are filled with a chemical irritant powder designed to temporarily incapacitate the person being shot.<\/p>\n<p>\u201cPepper projectile launchers are a commonly-used arm that many Americans choose as a non-lethal alternative to firearms,\u201d the lawsuit argues. \u201cCalifornia doesn\u2019t just deny its citizens this choice; it criminalizes the act of selling or possessing such an arm. This inexplicable ban violates the Second Amendment.\u201d<\/p>\n<p>The lawsuit argues that a unanimous U.S. Supreme Court decision from 2016 held that less-lethal stun guns qualify as arms protected by the Second Amendment. \u201cThe non-lethal arms at issue here are similarly protected,\u201d the lawsuit contends.<\/p>\n<p>The named plaintiffs in the suit are a woman who lives in San Diego County, a man who lives in Orange County and Byrna Technologies, described in the complaint as the manufacturer and seller of \u201cthe most popular pepper projectile launchers in the nation.\u201d Byrna\u2019s website informs would-be buyers that it <a href=\"https:\/\/byrna.com\/pages\/faq\" target=\"_blank\" rel=\"noopener nofollow\">does not ship its pepperballs to California<\/a>.<\/p>\n<p>They are suing Rob Bonta in his capacity as California\u2019s attorney general. Bonta\u2019s office did not immediately respond Tuesday to a request for comment.<\/p>\n<p>Weapons that fire pepper projectiles are banned in California because the projectiles fall under the state\u2019s definition of tear gas and the launchers fall under the state\u2019s definition of tear gas weapons. State law makes it <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=PEN&amp;sectionNum=22810.\" target=\"_blank\" rel=\"noopener nofollow\">illegal to own and possess such weapons<\/a> \u2014 with exceptions for law enforcement officers and some <a href=\"https:\/\/www.bsis.ca.gov\/forms_pubs\/tear_gas_weapons.pdf\" target=\"_blank\" rel=\"noopener nofollow\">certified security personnel<\/a> \u2014 as well as illegal to sell such weapons.<\/p>\n<p>\u201cThe primary advantage of a less-lethal weapon is its ability to neutralize a threat and protect one\u2019s family without the risk of causing permanent harm or death to either,\u201d the lawsuit argues. \u201c\u2026 For many law-abiding citizens, carrying a firearm for self-defense is not a practical or desirable option, yet these individuals have the same fundamental right to defend themselves. Pepper projectile launchers provide this critically needed defensive capability.\u201d<\/p>\n<p>The lawsuit also argues that pepperball weapons are a safer alternative to real firearms because the blunt impact of a pepperball is \u201ccomparable to a recreational paintball impact\u201d and only about one-tenth of the force of a 12-gauge beanbag round. The suit argues that serious injuries from the weapons are rare \u201csince they are specifically engineered to incapacitate through controlled irritation, and are not designed to inflict significant blunt trauma.\u201d<\/p>\n<p>While the Southern District of California has been a popular venue for firearms-rights groups to challenge California\u2019s various firearm restrictions, the San Diego federal court is also where Second Amendment groups have often turned to challenge California laws banning other weapons such as billy clubs and switchblades.<\/p>\n<p>A San Diego federal judge ruled last year that <a href=\"https:\/\/www.sandiegouniontribune.com\/2023\/04\/01\/bans-on-switchblades-have-been-overturned-around-the-country-is-california-next\/\" target=\"_blank\" rel=\"noopener nofollow\">California\u2019s ban on switchblades<\/a> is <a href=\"https:\/\/www.sandiegouniontribune.com\/2024\/08\/26\/san-diego-federal-judge-rules-californias-switchblade-ban-is-lawful\/\" target=\"_blank\" rel=\"noopener nofollow\">lawful<\/a>. The plaintiffs appealed that decision to a three-judge panel from the 9th U.S. Circuit Court of Appeals, which heard oral arguments in October.<\/p>\n<p>A different federal judge in San Diego ruled that <a href=\"https:\/\/www.sandiegouniontribune.com\/2024\/02\/26\/san-diego-federal-judge-rules-californias-ban-on-club-like-weapons-is-unconstitutional\/\" target=\"_blank\" rel=\"noopener nofollow\">California\u2019s ban on billy clubs, batons and other similar weapons violated the Second Amendment<\/a>. Bonta\u2019s office appealed that ruling to the 9th Circuit; that case has been placed on pause until the U.S. Supreme Court decides if it will hear another <a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/25-198.html\" target=\"_blank\" rel=\"noopener nofollow\">San Diego-based weapons case<\/a>.<\/p>\n<p>Under precedent set by the Supreme Court in 2022 in New York State Rifle &amp; Pistol Association, Inc. v. Bruen, California must be able to prove that its laws restricting weapons are \u201crooted in the Second Amendment\u2019s text, as informed by history \u2026 (and are) consistent with the nation\u2019s historical tradition of firearm regulation.\u201d The state must also prove that pepper projectile weapons are \u201cdangerous and unusual\u201d and not in common use.<\/p>\n<p>The lawsuit contends that Byrna has sold more than 750,000 of its pepperball weapons, proving that they\u2019re in common use and neither dangerous nor unusual.
