(KGET) \u2014 A motion seeking mental health diversion for Zack Scrivner, who\u2019s accused of inappropriately touching a child, was postponed Thursday and rescheduled for a hearing in Superior Court on the morning of Dec. 15.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">If the former county supervisor is granted entry and successfully completes a mental health diversion program, the case against him would be dismissed.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Scrivner, 51, is charged with three counts of child cruelty and two counts of illegally possessing an assault rifle.<\/p>\n<p><img alt=\"Zack Scrivner\u2019s defense attorney, H.A. Sala, listens during Thursday\u2019s hearing.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Judge Gloria Cannon noted Scrivner had a number of matters scheduled in her courtroom Thursday, including a status conference and a motion by the Attorney General\u2019s Office to postpone the hearing.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">She granted that motion, setting the motion for mental health diversion in Department 15, after which attorneys will return to Department 13 \u2014 her courtroom \u2014 for other matters.<\/p>\n<p><img alt=\"Deputy Attorney General Joseph Penney speaks to Judge Gloria Cannon (not pictured) during Thursday\u2019s hearing.\" loading=\"lazy\" width=\"900\" height=\"506\" decoding=\"async\" data-nimg=\"1\" class=\"rounded-lg\" style=\"color:transparent\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2025\/10\/06db5179ca7e430e3eeb86d0ed49002a.jpeg\"\/><\/p>\n<p>Deputy Attorney General Joseph Penney speaks to Judge Gloria Cannon (not pictured) during Thursday\u2019s hearing.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">A criminal complaint filed by the state AG\u2019s Office says Scrivner took mind-altering substances on the evening of April 23, 2024, then got in bed with and sexually penetrated a child.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">He also illegally possessed an AK-47 style rifle and an AR-15 style rifle, according to the complaint.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Scrivner was charged in February following a lengthy investigation. The AG\u2019s Office is handling the case because Scrivner is the nephew of Kern County District Attorney Cynthia Zimmer.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Copyright 2025 Nexstar Media, Inc.
