{"id":92393,"date":"2025-12-12T21:53:21","date_gmt":"2025-12-12T21:53:21","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/92393\/"},"modified":"2025-12-12T21:53:21","modified_gmt":"2025-12-12T21:53:21","slug":"la-city-attorney-accused-of-ethics-breach-before-settling-major-case-for-18m","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/92393\/","title":{"rendered":"LA city attorney accused of ethics breach before settling major case for $18M"},"content":{"rendered":"<p>It was one of the <a class=\"Link\" href=\"https:\/\/www.foxla.com\/news\/lapd-encino-crash-lawsuit-against-city-richard-stephen-paper\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">higher-profile<\/a> <a class=\"Link\" href=\"https:\/\/www.nbclosangeles.com\/investigations\/brothers-say-an-lapd-street-racing-officer-caused-high-speed-crash-that-left-them-with-serious-injuries\/3490035\/\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">lawsuits<\/a> against the city of L.A. over the past year.<\/p>\n<p>Two brothers in their 70s said they suffered serious injuries \u2014 including fractured skulls and spines \u2014 from a speeding LAPD officer <a class=\"Link\" href=\"https:\/\/www.latimes.com\/california\/story\/2025-10-12\/lapd-officers-traffic-incidents\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">crashing into the side of their car<\/a> at 55 mph.<\/p>\n<p>An investigator for the police department <a class=\"Link\" href=\"https:\/\/www.latimes.com\/california\/story\/2025-10-12\/lapd-officers-traffic-incidents\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">determined the officer was at fault<\/a> for driving at an unsafe speed.<\/p>\n<p>The city ultimately settled in the middle of the trial this September for $18 million.<\/p>\n<p>        Keep up with LAist.<\/p>\n<p>If you&#8217;re enjoying this article, you&#8217;ll love our daily newsletter, The LA Report. Each weekday, catch up on the 5 most pressing stories to start your morning in 3 minutes or less.  <\/p>\n<p>It\u2019s one of the city\u2019s most expensive lawsuit <a class=\"Link\" href=\"https:\/\/laist.com\/news\/politics\/los-angeles-liability-payments-costliest-cases\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">settlements over the past few years<\/a>, at a time the city has cut services due to a fiscal crisis driven largely by sharply rising legal payouts.<\/p>\n<p>An accusation in the case, however, has gone unreported. Days before settling the case, lawyers for the plaintiffs accused L.A.\u2019s elected city attorney of an ethics breach.<\/p>\n<p>As the case was about to go to trial, City Attorney Hydee Feldstein Soto called an expert witness for the plaintiffs, \u201cattempted to ingratiate herself with him and asked him to make a contribution to her political campaign,\u201d according to <a class=\"Link\" href=\"https:\/\/s3.documentcloud.org\/documents\/26364354\/stephen-paper-lawsuit-record-filed-2025-09-05-declaration-by-plaintiffs-attorney-about-city-attorneys-ex-parte-communication-with-plaintiffs-expert-witness.pdf\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">a sworn declaration to the court by the plaintiffs\u2019 attorney, Robert Glassman<\/a>.<\/p>\n<p>At the time of her Aug. 16 call, the expert witness \u2014 a neurosurgeon named Andrew Fox \u2014 was <a class=\"Link\" href=\"https:\/\/s3.documentcloud.org\/documents\/26364356\/stephen-paper-lawsuit-record-filed-2025-07-28-joint-witness-list.pdf\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">on the official witness list<\/a> for the upcoming trial and <a class=\"Link\" href=\"https:\/\/www.documentcloud.org\/documents\/26364355-stephen-paper-lawsuit-record-filed-2025-09-05-plaintiffs-notice-to-court-about-defenses-failure-to-pay-fees-to-plaintiffs-expert-witnesses\/#document\/p3\/a2774846\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">had been deposed by the city\u2019s attorneys<\/a>.<\/p>\n<p>According to <a class=\"Link\" href=\"https:\/\/www.documentcloud.org\/documents\/26364355-stephen-paper-lawsuit-record-filed-2025-09-05-plaintiffs-notice-to-court-about-defenses-failure-to-pay-fees-to-plaintiffs-expert-witnesses\/\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">a filing by the plaintiffs<\/a>, Feldstein Soto made the call <a class=\"Link\" href=\"https:\/\/www.documentcloud.org\/documents\/26364355-stephen-paper-lawsuit-record-filed-2025-09-05-plaintiffs-notice-to-court-about-defenses-failure-to-pay-fees-to-plaintiffs-expert-witnesses\/#document\/p147\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">while the city owed<\/a> Fox $5,000 to $6,000 in overdue deposition fees for the time the city spent questioning him before trial.<\/p>\n<p>By asking for a campaign donation from a testifying expert, <a class=\"Link\" href=\"https:\/\/s3.documentcloud.org\/documents\/26364354\/stephen-paper-lawsuit-record-filed-2025-09-05-declaration-by-plaintiffs-attorney-about-city-attorneys-ex-parte-communication-with-plaintiffs-expert-witness.pdf\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">Glassman alleged<\/a> Feldstein Soto violated <a class=\"Link\" href=\"https:\/\/www.calbar.ca.gov\/portals\/0\/documents\/rules\/rule_3.4-exec_summary-redline.pdf\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">a state ethics rule for attorneys<\/a>, which he wrote \u201cforbids interfering with any party\u2019s orderly access to a witness\u2019 testimony.\u201d<\/p>\n<p>\u201cThrough her ex parte communications and political solicitation designed to privately cultivate favor with plaintiffs\u2019 retained expert, she attempted to compromise plaintiffs\u2019 access to Dr. Fox\u2019s accurate and unbiased testimony,\u201d Glassman wrote in <a class=\"Link\" href=\"https:\/\/s3.documentcloud.org\/documents\/26364354\/stephen-paper-lawsuit-record-filed-2025-09-05-declaration-by-plaintiffs-attorney-about-city-attorneys-ex-parte-communication-with-plaintiffs-expert-witness.pdf\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">his Sept. 5 filing disclosing the call to the court<\/a>.<\/p>\n<p>\u201cIt placed Dr. Fox in an untenable bind, where any given response to her overtures invites pressure and a sense of obligation,\u201d he added.<\/p>\n<p>The city attorney\u2019s conduct, he alleged, was \u201cimproper and corrosive to the integrity of this trial.\u201d<\/p>\n<p>Six work days after Grossman\u2019s accusations, Feldstein Soto\u2019s office asked the city council for a closed session discussion where they greenlit settling the case. The $18 million settlement \u2014 handled by the city attorney&#8217;s second-in-command \u2014 was finalized before Fox was scheduled to take the witness stand in the trial.<\/p>\n<p>Feldstein Soto did not respond to an interview request through her spokesperson, Karen Richardson.<\/p>\n<p>In an emailed response to questions, Richardson said the settlement \u201chad nothing to do with Dr. Fox\u201d and \u201cwas a product of balancing comparative negligence with the amount and payment terms upon which the agreement was reached.\u201d<\/p>\n<p>Her campaign manager, Robb Korinke, told LAist the city attorney had been making a routine fundraising call. He said Feldstein Soto did not know Fox had a role in the case, nor that there were pending requests for her office to pay him fees.<\/p>\n<p>\u201cHydee had no awareness of his involvement in the case,\u201d Korinke said. \u201cHe didn\u2019t disclose that he was involved in this case, nor did he donate.\u201d<\/p>\n<p>How did he end up on the call list?<\/p>\n<p>Feldstein Soto called Fox because he was a donor to other campaigns in the county, Korinke told LAist.<\/p>\n<p>While Fox does not appear in searches of city and county campaign contribution databases, Korinke provided LAist with <a class=\"Link\" href=\"https:\/\/s3.documentcloud.org\/documents\/26367000\/nathan-hochman-fundraiser-invite-listing-andrew-fox-and-his-wife-as-co-hosts.pdf\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">an image of a fundraiser invite<\/a> for Nathan Hochman \u2014 when he was running for district attorney \u2014 that listed Fox and his wife as co-hosts. Fox did not respond to multiple phone messages for comment left with receptionists at his office.<\/p>\n<p>Asked if Feldstein Soto\u2019s campaign checked whether people she was going to ask for donations had pending matters before the city attorney\u2019s office so they could be screened out, Korinke said he couldn\u2019t speak to that because he\u2019s not the fundraiser.<\/p>\n<p>\u201cObviously, if Hydee recognizes someone she knows, she wouldn\u2019t call them, but I don\u2019t know what additional vetting they may have,\u201d he said. \u201cShe has no intention of knowingly contacting anyone that would have such a conflict.\u201d<\/p>\n<p>Retired Judge Jeremy Fogel said the city attorney\u2019s phone call would not be something the State Bar would follow up on for an ethics review if \u2014 as her campaign manager said \u2014 she did not know Fox was an expert witness in the case, and thus, it sounds like there was no intentional wrongdoing.<\/p>\n<p>But, he said, it raises the question of whether she or her team should be doing conflict checks before asking for campaign money.<\/p>\n<p>\u201cIt\u2019s not a bad idea\u201d to run checks before soliciting money, said Fogel, who was on the state and federal bench for more than three decades and now leads the Berkeley Judicial Institute at UC Berkeley\u2019s law school.<\/p>\n<p>\u201cWhen you have the resources we have now within information, you could probably find it in an electronic database. It might not be an undue burden,\u201d Fogel said.<\/p>\n<p>Nowadays, he said, software exists that helps flag potential conflicts based on comparing lists of names.<\/p>\n<p>\u201cIt\u2019s just saying you\u2019ve got a case, here\u2019s the witness list, and if you\u2019re going to solicit money, you should at least run a comparison so that you\u2019re not inadvertently soliciting somebody who&#8217;s on the other team. It would certainly be a good practice,\u201d Fogel said.<\/p>\n<p>When serving as a mediation judge, Fogel said, he would do a conflict check to make sure he wasn\u2019t handling a case where he knew one of the witnesses.<\/p>\n<p>Past controversies<\/p>\n<p>Brought into office by voters in late 2022, Feldstein Soto runs the largest elected city attorney\u2019s office in the country. <a class=\"Link\" href=\"https:\/\/cityattorney.lacity.gov\/about\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">More than 500 attorneys<\/a> work under her.<\/p>\n<p>In addition to serving as the city\u2019s top lawyer \u2014 representing the city in lawsuits and giving legal advice to city leaders \u2014 the city attorney also is in charge of prosecuting misdemeanor crimes within city boundaries.<\/p>\n<p>Feldstein Soto has been the focus of past controversies.<\/p>\n<p>In 2023, <a class=\"Link\" href=\"https:\/\/www.latimes.com\/homeless-housing\/story\/2023-07-11\/ousted-skid-row-receiver-hosted-fundraiser-for-city-attorneys-campaign\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">she picked a major campaign donor<\/a> with <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/skid-row-housing-trust-mark-adams-hydee-feldstein-soto-homeless-downtown\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">a problematic<\/a> <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/skid-row-housing-trust-mark-adams-hydee-feldstein-soto-homeless-downtown\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">history<\/a> to lead a major homeless housing provider without noting her campaign money connection.<\/p>\n<p>Months later, Feldstein Soto <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/skid-row-housing-trust-receiver-mark-adams-homeless-housing-hydee-feldstein-soto\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">said<\/a> the man she put in charge failed to make progress in fixing serious safety problems, failed to hire enough staff and <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/skid-row-housing-trust-receiver-mark-adams-los-angeles-homelessness\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">wrongfully told 451 tenants<\/a> they\u2019d be evicted.<\/p>\n<p>      How to reach me<\/p>\n<p>If you have a tip, you can reach me on Signal. My username is ngerda.47.<\/p>\n<p>Feldstein Soto ultimately <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/la-city-attorney-says-she-made-a-mistake-handling-skid-row-housing-trust-takeover\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">said she made a mistake<\/a> recommending him and <a class=\"Link\" href=\"https:\/\/www.latimes.com\/homeless-housing\/story\/2023-05-17\/skid-row-housing-trust-mark-adams-receiver\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">acknowledged not fully vetting his background<\/a>.<\/p>\n<p>In high-profile proceedings she observed in a homelessness lawsuit, Feldstein Soto <a class=\"Link\" href=\"https:\/\/laist.com\/news\/housing-homelessness\/gibson-dunn-legal-bills-city-homelessness-millions-city-council\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">allowed the city to incur over $3 million in outside lawyer bills without telling the city council<\/a>, despite the council authorizing just $900,000 for it. That prompted public frustration from some council members.<\/p>\n<p>In September, a longtime city prosecutor <a class=\"Link\" href=\"https:\/\/www.documentcloud.org\/documents\/26367003-la-city-attorney-lawsuit-declaration-by-michelle-mcginnis-in-sept-2025\/#document\/p5\/a2774964\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">alleged in a sworn declaration<\/a> that Feldstein Soto unlawfully demanded the dismissal of a case because the defendant was represented by a friend and maximum campaign donor. A spokesperson for Feldstein Soto <a class=\"Link\" href=\"https:\/\/www.latimes.com\/california\/story\/2024-06-13\/veteran-city-prosecutor-accuses-l-a-city-atty-hydee-feldstein-soto-of-legal-ethical-violations\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">has said<\/a> the allegations are untrue.<\/p>\n","protected":false},"excerpt":{"rendered":"It was one of the higher-profile lawsuits against the city of L.A. over the past year.
