{"id":99346,"date":"2025-12-18T06:02:18","date_gmt":"2025-12-18T06:02:18","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/99346\/"},"modified":"2025-12-18T06:02:18","modified_gmt":"2025-12-18T06:02:18","slug":"how-sfs-housing-plan-now-law-might-be-forced-back-to-the-drawing-board","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/99346\/","title":{"rendered":"How SF\u2019s Housing Plan, Now Law, Might Be Forced Back to the Drawing Board"},"content":{"rendered":"<p class=\"has-drop-cap\">San Francisco\u2019s long-brewing housing plan won final approval last week, but as soon as backers could pop champagne corks, a potential hangover hit the horizon.\u00a0<\/p>\n<p>A real estate developer unveiled plans for a 25-story apartment building, piling nearly 800 homes on top of the Marina District\u2019s famous Safeway. The proposal would expand the 60-year-old grocery store and include 86 affordable units.\u00a0<\/p>\n<p>The building immediately drew fire from opponents of the new zoning plan, who already feel emboldened to run political campaigns next year to fight back against taller, denser neighborhoods.\u00a0<\/p>\n<p>Given the political stakes, the Marina project also drew the scorn of the zoning plan\u2019s big backers: Sup. Stephen Sherrill, who represents the neighborhood, and Mayor Daniel Lurie himself. The mayor\u2019s office said the Family Zoning Plan, as they\u2019ve dubbed it, would in fact make the design illegal.\u00a0<\/p>\n<p>Mayoral spokesperson Charles Lutvak says the developer Align Real Estate is \u201ctrying to sneak in a project before our plan takes effect\u201d next year and calls it \u201ca complete violation of the spirit\u201d of the housing package. Align wasn\u2019t immediately available for comment.<\/p>\n<p>Anti-density folks say they\u2019ve gained momentum from the Joel Engardio recall, even though it was primarily fueled by the Great Highway closure. But the drawings of the Marina building \u2014 quite tall, indeed, as well as bright white with sleek curves and distinctive U-shaped profile, like an alien cruise ship \u2014 serve as a notable moment as observers try to gauge, absent any polling, how hot the housing issue really is.\u00a0<\/p>\n<p><img loading=\"lazy\" data-recalc-dims=\"1\" decoding=\"async\" width=\"1024\" height=\"612\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2025\/12\/Marina3.jpg\" alt=\"An architect's rendering of a large apartment building viewed from street level.\" class=\"wp-image-19089\"  \/>A street level view, via the architect\u2019s rendering, of 15 Marina Blvd. The mayor\u2019s office says they\u2019ll do everything they can to block the proposal.  (Arquitectonica)<\/p>\n<p>\u201cThe problem with housing fights in San Francisco is it\u2019s all speculative,\u201d political consultant Jim Ross tells The Frisc. \u201cBut if they start proposing more towers like this,\u201d the hypothetical becomes more real.\u00a0<\/p>\n<p>If SF residents, like many local politicians, have tipped over to believing in the benefits of a denser city, the \u201cmore real\u201d of more homes might mean the Engardio recall momentum would stop at the boundaries of the Sunset District.\u00a0<\/p>\n<p>\t\t\t\t\t\t\t\t<a href=\"https:\/\/thefrisc.com\/fear-of-heights-why-a-planned-tower-near-sfs-waterfront-keeps-rising-despite-aaron-peskins-best-efforts\/\" rel=\"bookmark nofollow noopener\" tabindex=\"-1\" aria-hidden=\"true\" target=\"_blank\"><br \/>\n\t\t\t\t\t\t\t\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"900\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2025\/12\/955-Sansome-Street-looking-down-Vallejo-from-New-Montgomery-Street-rendering-by-Handel-Architects.jp.jpeg\" class=\"attachment-newspack-article-block-landscape-large size-newspack-article-block-landscape-large wp-post-image\" alt=\"Fear of Heights: Why A Planned Tower Near SF\u2019s Waterfront Keeps Rising, Despite Aaron Peskin\u2019s Best Efforts\" data-hero-candidate=\"1\"  \/>\t\t\t\t\t\t\t\t\t\t\t\t<\/a><\/p>\n<p>But if <a href=\"https:\/\/thefrisc.com\/fear-of-heights-why-a-planned-tower-near-sfs-waterfront-keeps-rising-despite-aaron-peskins-best-efforts\/\" rel=\"nofollow noopener\" target=\"_blank\">fear of towers<\/a> is a hard habit to break, Lurie\u2019s board allies, including Sherrill, could face tough elections in 2026. The board could even tip back to an anti-density majority in 2027. And if that happens, the Marina project\u2019s resemblance to an iceberg will start to feel ominous.\u00a0<\/p>\n<p>That\u2019s because the city will likely have to revisit its housing plan in 2027, thanks to a small clause in the governing documents. Some people call it a circuit breaker. (Some people call it a <a href=\"https:\/\/thefrisc.com\/if-san-francisco-doesnt-crank-up-housing-by-2027-a-backup-plan-will-trigger-more-drastic-reforms\/\" rel=\"nofollow noopener\" target=\"_blank\">dirty bomb<\/a>.) And because SF construction is a relative trickle these days, the clause is likely to set off new housing fights similar to the one we just finished.<\/p>\n<p>Winter 2027 is coming<\/p>\n<p>When San Francisco first crafted its housing blueprint \u2014 the Family Zoning Plan was just one part \u2014 state regulators said its development projections were too optimistic. They forced SF lawmakers to add a provision known as the circuit breaker.<\/p>\n<p><a href=\"https:\/\/sfplanning.s3.amazonaws.com\/archives\/sfhousingelement.org\/files\/Housing_Element_2022_Update.pdf\" rel=\"nofollow noopener\" target=\"_blank\">The rule<\/a> gave SF four years, from Jan. 2023 to Jan. 2027, to issue building permits for at least 29,049 new housing units. Coming up short could trigger a zoning do-over to encourage more development.<\/p>\n<p>The clause doesn\u2019t say precisely what the city must do, only that it will constitute \u201cadditional rezoning\u201d and \u201cadditional constraints reduction.\u201d In other words, everything that just got Lurie\u2019s signature would just be the starting point.\u00a0<\/p>\n<p> The current pace of incoming permits would not lead us to where we need to be.<\/p>\n<p>SFPlanning Director Sarah Dennis Phillips<\/p>\n<p>The clause does give a target to shoot for: Whatever the gap between the actual permit count and the 29,000-plus goal, the city must create room for that many homes, plus another 15 percent.\u00a0<\/p>\n<p>Ultimately, state regulators would decide if this new new housing plan fulfills those goals.<\/p>\n<p>And the time is coming: Of those 29,000 permits, SF delivered about 4,000 in 2023 and 2024, with about 4,000 more likely in 2025. It will need more than 20,000 new permits in 2026 to avoid tripping the circuit breaker.\u00a0<\/p>\n<p>\u201cAs of now, the current pace of incoming permits would not lead us to where we need to be,\u201d Planning Director Sarah Dennis Phillips tells The Frisc. \u201cOur planners have been working hard, but we can only move forward what is in front of us.\u201d\u00a0<\/p>\n<p>\t\t\t\t\t\t\t\t<a href=\"https:\/\/thefrisc.com\/daniel-luries-new-planning-director-has-her-eyes-on-a-housing-long-game\/\" rel=\"bookmark nofollow noopener\" tabindex=\"-1\" aria-hidden=\"true\" target=\"_blank\"><br \/>\n\t\t\t\t\t\t\t\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"900\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2025\/12\/Sarah-Dennis-Phillips-in-City-Hall_Alex-1750x-wide.jpeg\" class=\"attachment-newspack-article-block-landscape-large size-newspack-article-block-landscape-large wp-post-image\" alt=\"Daniel Lurie\u2019s New Planning Director Has Her Eyes On A Housing \u2018Long Game\u2019\" data-hero-candidate=\"1\"  \/>\t\t\t\t\t\t\t\t\t\t\t\t<\/a><\/p>\n<p>Dennis-Phillips adds that they\u2019re hoping more projects in the housing pipeline move towards the permit stage.\u00a0<\/p>\n<p>Planning has not identified which neighborhoods and streets might be in play if the circuit breaker demands a new round of upzoning. But the same \u201cpriority equity\u201d neighborhoods, such as Chinatown, the Tenderloin, and the Mission, will <a href=\"https:\/\/thefrisc.com\/sf-plans-more-housing-but-not-everywhere-heres-why-the-tenderloin-isn-t-on-the-map-349321ec20e4\/\" rel=\"nofollow noopener\" target=\"_blank\">remain off-limits<\/a>, says Dennis Phillips.\u00a0<\/p>\n<p>\t\t\t\t\t\t\t\t<a href=\"https:\/\/thefrisc.com\/sf-plans-more-housing-but-not-everywhere-heres-why-the-tenderloin-isn-t-on-the-map-349321ec20e4\/\" rel=\"bookmark nofollow noopener\" tabindex=\"-1\" aria-hidden=\"true\" target=\"_blank\"><br \/>\n\t\t\t\t\t\t\t\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"800\" height=\"600\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2025\/12\/1h6Mcif7kaN2X16kpyf7fnA.jpeg\" class=\"attachment-newspack-article-block-landscape-medium size-newspack-article-block-landscape-medium wp-post-image\" alt=\"SF Plans More Housing, but Not Everywhere. Why the Tenderloin Isn\u2019t On the Map\" data-hero-candidate=\"1\"  \/>\t\t\t\t\t\t\t\t\t\t\t\t<\/a><\/p>\n<p>Here\u2019s where next year\u2019s political maneuvers come in: the Board of Supervisors must approve new zoning plans.\u00a0<\/p>\n<p>If SF lawmakers vote no, the city risks state fines and other penalties, including the <a href=\"https:\/\/thefrisc.com\/daniel-lurie-warns-of-towers-everywhere-if-sfs-housing-plan-fails\/\" rel=\"nofollow noopener\" target=\"_blank\">Builder\u2019s Remedy<\/a>, just like it did if the Family Zoning Plan hadn\u2019t passed.\u00a0<\/p>\n<p>Do the supervisor math<\/p>\n<p>The Family Zoning Plan passed by a 7 to 4 margin. Five of the \u201cyes\u201d votes represent districts with elections next year. Only one of the \u201cnays,\u201d Sup. Shamann Walton, comes from a district on the 2026 ballot. (Walton is termed out.)\u00a0<\/p>\n<p>So if two of Lurie\u2019s allies are replaced by upzoning opponents, and if the anti-density faction holds onto Walton\u2019s seat, the new board that convenes in 2027 could be a slight anti-density majority.\u00a0<\/p>\n<p><a href=\"https:\/\/bsky.app\/profile\/thefrisc.bsky.social\/post\/3m2nftzdfk22t\" rel=\"nofollow noopener\" target=\"_blank\"><img loading=\"lazy\" data-recalc-dims=\"1\" decoding=\"async\" width=\"1024\" height=\"846\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2025\/12\/Live-Thread-10.10.25-Sherrill.png\" alt=\"\" class=\"wp-image-17933\"\/><\/a>At an October <a href=\"https:\/\/bsky.app\/profile\/thefrisc.bsky.social\/post\/3m2nftzdfk22t\" rel=\"nofollow noopener\" target=\"_blank\">town hall<\/a>, Sup. Stephen Sherrill defended the Family Zoning Plan as a way to keep local housing control. Sherrill is facing a challenge next year over his support for the plan.<\/p>\n<p>\u201c\u200b\u200bThey have staked out a politically popular position that they can use to hammer Lurie and his allies,\u201d says San Francisco State University political scientist Jason McDaniel.\u00a0<\/p>\n<p>Board President Rafael Mandelman (District 8) is termed out next year. Sherrill (District 2) is already facing a challenge from a staunch Family Zoning Plan opponent, Lori Brooke. Perhaps most closely watched will be the ever-volatile District 4, which has already seen the Engardio recall and his replacement, Beya Alcaraz, last one embarrassing week in office.\u00a0<\/p>\n<p>Lurie then turned to Alan Wong, who must first run in a June special election to make it through to November\u2019s contest. Opponents will try to use his Family Zoning Plan \u201caye\u201d vote \u2014 his first major act in office \u2014 against him.\u00a0<\/p>\n<p>\u201cI thought it was an insensitive vote,\u201d Sunset business owner Albert Chow told The Frisc one day before Chow announced plans to run against Wong. Welcome to the Sunset District\" data-hero-candidate=\"1\"  \/>\t\t\t\t\t\t\t\t\t\t\t\t<\/a><\/p>\n<p>Wong tells The Frisc he stands by his vote: \u201cIt\u2019s my duty to make tough, practical, and responsible decisions.\u201d\u00a0<\/p>\n<p>The board\u2019s biggest Family Zoning Plan champion is Sup. Myrna Melgar, who shepherded it through her key Land Use Committee. Melgar\u2019s term runs through 2028, but zoning opponents are threatening to mount a recall. Melgar has brushed off the threats.<\/p>\n<p>With so many variables in play, it\u2019s plausible a new board will be quite hostile to the idea of more upzoning, even if faced with Sacramento\u2019s ire, which means 2027 could make for a housing staredown between the city and state. Just weeks after the new board members are seated in Jan. 2027, the circuit breaker deadline will arrive.\u00a0<\/p>\n<p>Threats from allies too<\/p>\n<p>District 2 challenger Brooke has surprised no one by threatening a lawsuit against the Family Zoning Plan via her group Neighborhoods United, according to a letter the group\u2019s lawyers <a href=\"https:\/\/www.sfchronicle.com\/sf\/article\/lurie-rezoning-housing-battle-21208509.php\" rel=\"nofollow noopener\" target=\"_blank\">sent to the supervisors<\/a>.\u00a0<\/p>\n<p>More surprising is a legal threat from a fervently pro-housing group, the California Housing Defense Fund. It usually makes headlines for suing NIMBY-aligned cities for dragging their feet on new housing. But the fund also says the Family Zoning Plan doesn\u2019t go far enough, despite raising height limits and encouraging more density in SF neighborhoods that rarely catch a whiff of a construction site.<\/p>\n<p>Executive director Dylan Casey tells The Frisc they\u2019ll file a lawsuit after the plan hits its state deadline at the end of January.\u00a0<\/p>\n<p>Critics got a boost in October from SF chief economist Ted Egan, who projected that the new housing map, in the rosier of two scenarios, would only produce about a third of what planners have hoped for.\u00a0<\/p>\n<p>Egan did nevertheless encourage the city to vote the plan through. Even his guarded math predicted thousands of new homes and lower housing prices for the average San Franciscan.<\/p>\n<p>But those savings would amount to only a few hundred dollars and would take decades to appear. \u201cThe biggest savings would be in 2045,\u201d Egan told The Frisc. That leaves the plan exposed to criticism from the YIMBY flank, and possibly even litigation.<\/p>\n<p>As for the Marina Safeway site, the mayor\u2019s office tells The Frisc they plan to use \u201cevery lever\u201d available to block the proposal. That\u2019d be one less thing to worry about going into the election year.
