Court grants SeaWorld Orlando request to dismiss coaster duck strike lawsuit

ORLANDO, Fla. – SeaWorld Orlando’s motion to dismiss a lawsuit filed by a woman who claims she was injured by a duck while riding a roller coaster was granted by a Florida court.

The lawsuit says that the rider — identified as Hillary Martin of Orange County — was injured by a duck while riding Mako in March, stating she suffered permanent injuries and seeks more than $50,000 in damages.

Martin is accusing the theme park of “creating a zone of danger,” largely due to Mako’s high speed and placement near a body of water, which allegedly increased the risk of bird strikes.

SeaWorld Orlando sought dismissal of the case, arguing the incident was unforeseeable and outside the park’s control.

According to court documents filed on Tuesday, Martin has 20 days to refile an amended complaint.
