Lawsuit challenges DeSantis authority on Florida redistricting session

  • February 6, 2026

TALLAHASSEE, Fla. (WCTV/Gray Florida Capital Bureau) – A lawsuit filed with the Florida Supreme Court Thursday seeks to stop mid-decade congressional redistricting planned for this spring.

Gov. Ron DeSantis called for a special session on congressional redistricting last month as part of a national effort across the country, particularly in Republican-leaning states, to try to stay in control of Congress after the midterms.

Florida politics:

The lawsuit claims the governor is overstepping his authority. In his special session announcement, DeSantis declared this year as “a year in which the Legislature will apportion the State” to extend some filing deadlines.

The lawsuit argues that only the legislature has the authority to make that declaration. It asks the Supreme Court to order the governor’s declaration as not binding and enforceable until the legislature acts on the issue.

The congressional redistricting special session is scheduled for April.
