A North Miami Beach band teacher has been arrested after he was accused of inappropriate relationships with multiple students.
Jose Francisco Montes-Guedez, 40, was arrested Friday on two counts of offenses against students by authority figures, two counts of battery – touch or strike, and three counts of contributing to the delinquency of a child, Miami-Dade jail records showed.

According to an arrest report, Montes is a band teacher at Alonzo and Tracy Mourning Senior High Biscayne Bay School in North Miami Beach.
On social media, Montes promotes himself as an award-winning bass player.
An investigation into Montes began in November 2025 after an argument involving an alleged victim and another student over allegations of a relationship with Montes led to a physical altercation in his band room at the end of the 2024-2025 school year, the report said.
One alleged victim said she met Montes through another student, and he allowed her to stay in his classroom during school hours while she skipped classes, the report said.
She said they formed a close friendship and he gave her advice about relationships, and she said he would confiscate nicotine and THC vape pens from other students and give them to her, the report said.
The student said she was 16 and approaching 17 when he was giving her the vapes, and on one occasion, he asked her for a kiss in exchange for a vape pen, the report said.
In one incident, she said Montes requested her assistance in a small room with no window and once inside, he grabbed her by the waist against her will, touched her face and kissed her on the lips, the report said.
She said she pushed Montes away and after that incident she “maintained her distance” from him, the report said.
Another 17-year-old student who was in his chorus class said Montes told her he had contacts in the music industry and befriended her, the report said.
She said he would speak about his sexual relationships when he was young and gave her friend a vape pen, then gave her vape pens on multiple occasions, the report said.
On one occasion, he told her to wait for him in his office after school because he had something to give her, then grabbed her by the waist and pulled her into him, the report said.
She said she was shocked, pushed him away and ran out of the room crying.
A third student, who was 16, said she’d been Montes’ student for three years and considered him a friend, saying he allowed her to stay in his classroom when she skipped class and he would buy her food, the report said.
She said Montes gave her advice about family and relationship issues and would give details of sexual experiences from college and once asked her and her friends if they ever participated in a threesome, the report said.
The girl said she’d been asked by a friend to accompany her to ask Montes for a vape pen and said she asked for one too and he gave her one, and said he kept giving them to her without her requesting them and once offered her two THC vape pens but she declined, the report said.
Montes was interviewed by detectives on Friday and said he “provided a safe space” for the girls because they felt comfortable with him and shared details of their personal lives, the report said.
He admitted to touching one girl’s shoulder when he was alone with her in his office and said he apologized to her for making her feel uncomfortable, the report said.
Montes also admitted to confiscating vape pens and said he turned them over to school administrators but would temporarily keep some and that the girls knew where he kept them, the report said.
He said he never personally handed them to the girls but allowed them to take them from his bookbag and acknowledged that was inappropriate, the report said.
Montes was arrested and booked into jail before appearing before a bond court judge over the weekend as his wife appeared on a video call.
“These allegations are pretty serious, I think he’s gonna end up in divorce court, that’s just my reading of this,” Judge David H. Young said.
Young asked Montes’ wife if she knew the charges and if he’s welcome back in her home, and she said yes
Montes’ bond was set at $16,000 with house arrest, and he was ordered to stay away from the three alleged victims.
In a statement Monday, a Miami-Dade County Public Schools spokesperson said they’re aware of the arrest.
“Miami-Dade County Public Schools (M‑DCPS) is aware of the arrest of an employee from Alonzo and Tracy Mourning Senior High School by the Miami-Dade Schools Police Department. M‑DCPS holds all employees to the highest standards of integrity and respect, and this type of conduct will not be tolerated,” the statement reads. “The District has initiated employment termination proceedings and will ensure the individual is precluded from seeking future employment with M‑DCPS.”
