Mistrial declared in trial of Tallahassee man accused in fentanyl death of 3-year-old

TALLAHASSEE, Fla. (WCTV) – A mistrial was declared late this afternoon in the trial of Tony Balcom.

Balcom is accused of aggravated manslaughter in the death of three year old Enrique Evans.

Evans died in January 2023 after ingesting a fatal dose of fentanyl.

The jury deliberated for around five hours before telling the judge they could not agree on a verdict.

Testimony in the case began Wednesday and prosecutors argued Balcom, who was not the toddler’s father, but his primary caregiver, did not supervise him properly.

A friend of Balcom’s testified Wednesday, telling the jury that Balcom often dealt drugs out of the apartment.

Prosecutors said they will retry the case, which could happen as early as next month.

The child’s mother, Cameren Evans, has already been convicted in his death. A mistrial was also declared the first time Evans was tried in 2025.

The jury deliberated for almost eight hours before telling the judge they could not reach a unanimous verdict.

Evans was found ultimately found guilty earlier this month.
