A West Miami-Dade dentist changed his name around the time his Washington license was suspended indefinitely after infection control violations.
But only part of that really bothered the Florida Department of Health about Sidney Moritz, once known as Sandy Montano.
The department’s administrative complaint, filed Jan. 16, said in addition to his license being suspended in Washington, Moritz didn’t let Florida know about it within 30 days. Also, the state says while still Sandy Montano, he worked for Majestic Family Dental Clinic Inc., and owned Majestic with his mother, Marina Montano. Dentists practicing for an ownership group that includes non-dentists is a no-no in Florida.
Administrative complaints start the disciplinary process, which can end from exoneration to license revocation.
Moritz is represented by Gordon Rees Scully Mansukhani associates Drew Dymowski and Capri Trigo.
“We have no comment as it is an ongoing matter,” Dymowski said in an email to the Miami Herald.
Moritz has no previous disciplinary actions on the Florida license he acquired Dec. 28, 2016. That’s not the case for the Washington license he was first issued Oct. 19, 2015, as Sandy Fletcher Montano.
The state of Washington’s Dental Quality Assurance Commission investigated Montano’s office in the Spokane suburb of Deer Park after a Nov. 17, 2021, complaint accusing Montano of “patient safety and infection control violations.”
The final order on Montano’s license suspension said witnesses confirmed that:
Montano, from Nov. 8-16, 2021, “retrieved used x-ray barriers, towels and suctions from the trash or assigned receptacle and placed them with unused ones.”
He “mixed topical gel with non-ingestible lidocaine.”
He “failed to maintain clean water lines.”
He “failed to always use gloves when working with patients and/or used dirty or damaged gloves.”
He “used powdered charcoal and pumice with toothpaste.”
One of Montano’s dental assistants didn’t have a license and did “tasks and procedures that require an active license.”
Also, on Dec. 1, 2021, when an investigator showed up at his place, Montano “declined to allow the inspection to proceed.”
Because of what it termed the “immediate danger” Montano’s violations brought, Washington suspended Montano’s license on June 21, 2022, until a hearing could on the case. On July 19, 2022, Montano filed his answer and requested a hearing on the charges.
After seven continuances, the last six of which were requested by Montano, he didn’t show up for a Dec. 5, 2023, hearing and a Dec. 28, 2023, prehearing conference. That’s when Washington’s Department of Health motioned for and received an Order of Default against Montano.
For the violations and drawing the default order, the commission sanctioned Montano by turning the 2022 suspension into an indefinite suspension that’s dated April 9, 2024.
Montano filed for a name change in Miami-Dade Circuit Court on Nov. 14, 2023, two months after his last request for a continuance in his Washington case. He woke up on Feb. 5, 2024, as Sandy Fletcher Montano and went to bed that night after the final judgment as Sidney Solomon Moritz.
Moritz’s name changed on his Florida Department of Health license. But he continues to use “Sandy Montano” on the state corporate paperwork for the still-active LLC “Dr. S & F,” the address of which he switched on Feb. 3 from a Southwest Fourth Street house to the U.S. Post Office branch at 8880 SW Eighth St.
Just east of the post office branch, at 8150 SW Eighth St., is Majestic Family Dental Clinic, which Florida state records say Montano and his mother reinstated as a company in 2001. From 2001-2011 and 2019-2024, Montano was a listed officer, usually as company president. Marina Montano was listed as secretary from 2001-2009 and 2011-2025.
“From March 4, 2021, through Oct. 16, 2024, [Montano] owned Majestic Dental Clinic, Inc. with Marina Montano,” the Florida Department of Health complaint said. “At all times material to this complaint, Marina Montano was not a licensed dentist. As of Oct. 16, 2024, Marina Montano is the sole owner of Dental Clinic, Inc.”
The complaint says Montano violated Florida Statute Section 466.028(1)(h) by being a dentist “employed by a corporation, organization, group, or person other than a dentist or a professional corporation or limited liability company composed of dentists.”
Secretary Marina Montano is the only officer that appears on the 2025 state corporate filing. But the latest filing, from Feb. 5, shows President Sidney Moritz as the lone officer and registered agent.
