The lawsuit, which seeks $50,000 in damages for each twin, alleges that the brothers sustained “significant injuries to their necks and backs” following a sudden ride stop.
Harry Potter & the Battle at the Ministry Lawsuit

Twin brothers Derrick and Erick Borrough of Georgia, both 45, are represented by law firm Morgan & Morgan, which filed the case in Orange County on February 20. The lawsuit alleges that the brothers sustained “neck and back injuries” after being “thrusted erratically” during a malfunction that caused the ride to stop suddenly. The incident occurred on December 25, 2025.
The brothers are seeking $50,000 in damages each for “disability, physical impairment, disfigurement, mental anguish and inconvenience; expense of hospitalization, medical and nursing care and treatment; and past lost wages, loss of earning power and diminished earning capacity.”
Universal has not responded to the allegations.
This is the first lawsuit to be filed regarding Harry Potter and the Battle at the Ministry, arguably the park’s most popular ride: the attraction has reached capacity on multiple occasions and posted waits of up to five hours.
While Epic Universe has dealt with several lawsuits since the park’s opening in May 2025, all so far have related to Stardust Racers, the roller coaster located in Celestial Park. These include the wrongful death of Kevin Rodriguez Zavala — his family ultimately reached an “amicable resolution” with Universal — and five additional injury lawsuits, which were also settled.
