According to The Orlando Sentinel, two men are suing Universal Orlando over alleged injuries they sustained when riding Harry Potter and the Ministry of Magic in Universal’s Epic Universe.

The lawsuit alleges that a malfunction of the ride caused both men to sustain injuries.

The men, Derrick Burrough and Erick Burrough, who are brothers, filed the lawsuit that seeks $50,000 in damages from Universal. The two lawsuits claim they suffered injuries resulting in the “loss of ability to lead and enjoy a normal life” when they rode Harry Potter and the Battle at the Ministry in Epic Universe with their family on Christmas Day last year.

The lawsuit claims that a ride malfunction occurred while they were seated on the ride, causing the ride vehicle to come to an abrupt stop, causing the brothers to be “thrusted erratically” in their seats. The lawsuit claims that this caused both men to sustain “significant” injuries to their necks and backs.

The lawsuit claims that Universal was negligent in maintaining the ride by failing to fix “a dangerous condition about which the defendant either knew or should have known.” The lawsuits alleged that the men suffered “disability, physical impairment, disfigurement, mental anguish and inconvenience; expense of hospitalization, medical and nursing care and treatment; and past lost wages, loss of earning power and diminished earning capacity.”

“The most important job of a theme park is to keep its guests safe. Instead, Universal allegedly operated a ride that had been plagued by repeated malfunctions, glitches, and hard stops since it opened,” attorney John Morgan said in the release. “Our clients continue to seek treatment for their injuries, which are impacting their everyday lives. They have filed these lawsuits to hold Universal accountable for a safety incident we allege was entirely preventable.”
