CAPE CORAL, Fla. (WINK) — Thomas Stein’s defense team filed a motion Tuesday afternoon requesting a new trial.

Stein was found guilty last week for the homicide of 15-year-old Kayla Rincon-Miller in Cape Coral two years ago.

The motion argues there was insufficient evidence to support the trial.

It also claims the defense was harmed by a key witness changing testimony without notice. The court improperly limited the defense’s ability to call witnesses, according to the motion.

Stein is scheduled to be sentenced in July.
