TALLAHASSEE, Fla. (WCTV) – The trial for a Tallahassee man accused of abusing and killing his step-daughter has been delayed for a second time.
Court records show Daniel Spencer’s attorneys filed a motion to continue, citing the need for additional time to prepare for the possible penalty phase of the trial.
The trial was previously slated to start on June 22. Court documents show the motion to continue was granted on Thursday.
Spencer’s trial, expected to span two weeks, is now scheduled to begin September 22, 2026.
The is the second time Spencer’s trial has been delayed. He was previously set to stand trial on November 10, 2025 before his defense attorney filed a request to continue to the case, moving it to June 22.
Spencer is accused of beating and killing his step-daughter, five-year-old Missy Mogle.
Missy’s mother, Chloe Spencer, is also accused in the girl’s death.
Both could face the death penalty if convicted.
Missy’s death sparked the creation and signing of Missy’s Law, which mandates judges revoke a person’s bond if they have been convicted of dangerous crimes, including sex offenses.
Daniel Spencer was out on bail awaiting sentencing for traveling to meet a minor when Missy was killed.
