A man convicted in Volusia County of unlicensed contracting may get a plea agreement to avoid trial in two Orange County criminal cases. A judge on Friday set a hearing for July 31 for the attorney of Cat 5 Prefab Homes president Anson Gallaway to explain how both cases might be resolved. The attorney, Bruce Johns, has been handling the criminal cases against Gallaway since WESH 2 Investigates first exposed him as an unlicensed contractor. He’s not only been convicted and fined by the state for pocketing money on a variety of unfinished, local construction jobs, but he’s also serving probation for his conviction in the U.S. Virgin Islands for taking more than half a million dollars from customers and failing to deliver new, prefabricated homes. Johns told the judge at Friday’s hearing, in a misdemeanor case, that he is meeting with the 9th Circuit assistant state attorney handling the felony cases against Gallaway in hopes of disposing of both cases at once. Johns said that he expects to have a “global resolution” — a plea arrangement — to avoid trial and settle the Orange County cases in a matter of weeks. Sitting and watching in court, and simmering over yet another delay, was Juliette Harrell. She is the alleged victim in the misdemeanor case. Harrell said she paid Gallaway $45,000 for an accessory dwelling unit in her backyard, but nothing has been built. Harrell added, “I think he has dragged this thing on enough and also I’m hoping that this all stays on record, so he can’t do this to somebody else.” The two cases that are being handled at the Orange County courthouse, against Gallaway, are in addition to another criminal case that was just settled in Volusia County.
