A fired Cuban worker for the City of Tampa didn’t endure severe or pervasive enough treatment to support a national origin bias claim, despite allegations that his coworkers made several derogatory comments about Hispanic people, according to a federal district judge.
Over five years working at the City of Tampa Water Department, water plant operator Albert Chavez said his coworkers made discriminatory comments — among them that a sludge room resembled a “Mexican bowl,” that “Mexicans eat the shit out of sand cranes,” and how a cleaner had performed poorly “probably because she’s Cuban”.
