CHARLOTTE COUNTY, Fla. (WWSB) – The state attorney’s office will not file charges against a former Charlotte County Sheriff’s deputy who shot a man during a disturbance call in 2025.
“On June 30, 2026, we received formal written notice from the State Attorney’s Office indicating, after a full review of the case, it has been determined that there was no violation of the law,” Sheriff Bill Prummell said in a statement Friday.
Poole was responding to a call reporting of a battery occurring at the Deep Creek Golf Club.
During a conversation with the complainant, Daniel Burch came out of a neighboring apartment and began to threaten the complainant.
Body camera footage shows Poole pulling out his taser “as a show of force,” Prummell said. When Burch did not retreat, Poole deployed the taser twice but it did not affect Burch, who lunged at the deputy several times.
Poole then drew his service weapon and ordered Burch to the ground. When Burch reached for his weapon, Poole fired several times, striking Burch, who died from his wounds.
On Friday, Prummell said he was “disheartened” with the state attorney’s decision. “Though it was determined by the State that there was no violation of law, we have sustained several policy violations,” he said.
Prummell said Poole used poor tactics while approaching Burch and failed to de-escalate the situation.
“if it weren’t for the fact that … Poole retired just after the shooting, based on the facts of this investigation, it would have been my intent to withdraw his appointment from the Office,” Prummell said in the statement.
The sheriff’s office said it considers the case closed and would have no further comment.
