Bivens and Walters were both from the Fort Lauderdale, Florida, area. The man told investigators he’d driven up over the weekend to surprise his girlfriend.

Investigators said Bivens told them he choked Walters during what he said was a consensual act last Sunday. However, a detective testified that defensive wounds were found on the man’s body that were inconsistent with his story.

He appeared in court Wednesday for an Aniah’s Law hearing, where a homicide detective on the case testified the suspect had been cooperative with police, answering all questions after he was read his Miranda rights.

The suspect’s bond is set at $175,000. However, as part of the bond agreement, District Judge Pamela Higgins forbid Bivens from leaving Alabama without court permission.
