BREVARD COUNTY, Fla. (CBS12) — Four people are facing charges after deputies say they were caught illegally harvesting palmetto berries on private property in Brevard County.

According to the Brevard County Sheriff’s Office, deputies were patrolling when they spotted two vehicles parked on private property that did not have vehicle access.

Sheriff Wayne Ivey said deputies approached one of the people, identified as Daniel Depace, and saw others hiding in nearby bushes.

Depace told deputies he had a permit to harvest palmetto berries, but investigators determined the permit was not valid for the property where he was found, according to the sheriff’s office.

Three others — Sonya Sloan, Ivan Flores and Shyeim Campbell — were also detained. Deputies said none of them had permits.

The sheriff’s office said the group had already harvested approximately 200 pounds of palmetto berries.

Sloan was charged with harvesting palmetto berries without permission, resisting without violence and violation of probation. Campbell, Flores and Depace were each charged with harvesting palmetto berries without permission.

Ivey said illegal palmetto berry harvesting is a serious offense and warned people against trespassing on private property to collect the berries for profit.

Florida law makes it a felony to illegally harvest and sell palmetto berries. The berries are used to produce saw palmetto extract, which is commonly used in products marketed for prostate health.

Ivey also warned that illegal berry harvesting can be connected to other crimes, including human trafficking, although he did not allege human trafficking occurred in this case.

“Get your permit, get the property owners’ permission and you’ll have no problems,” Ivey said.

Ivey delivered the warning loud and clear: “Stop picking those damn berries!”
