A Key West police officer was questioned and arrested by members of his own department after they found him sitting behind the wheel of his pickup truck. Newly released body camera video shows the off-duty officer admitting that he had “a few” drinks but denying that he drove the truck there.

The incident happened around 5 a.m. on Sunday, Aug. 16. Officers found Dustin Christina, 40, in the driver’s seat of a white Ford pickup parked near Old City Hall off Greene Street.

The truck was not moving when officers approached it. However, police said they had seen Christina driving a couple of hours earlier.

According to the arrest report obtained by Local 10, Christina turned from Greene Street onto Ann Street and nearly hit a woman. She reportedly had to run onto the curb to get out of the way.

He Said Someone Else Drove the Truck

When one of the officers asked Christina how much he had to drink, he replied, “I had a few.” Christina then said he was not the person who drove his truck into the parking lot. He told the officers that someone else had driven it there and that he was waiting for a ride.

Police said Christina had a blank stare, a flushed face and eyes that appeared bloodshot, glassy and watery. They also reported smelling alcohol while speaking with him.

He Stumbled After Getting Out

The arrest report says Christina stumbled backward against his truck when he got out. He then tried to close the driver’s door, missed it and stumbled away from the vehicle.

Officers asked him to complete DUI tests, but he refused. “Nah, I’m not doing it,” Christina said. “I’m sitting here in a non-running vehicle.” A supervising officer was called to the scene and determined there was probable cause to arrest him.

The Truck Did Not Have To Be Moving

Christina repeatedly pointed out that the truck was parked and its engine was not running. Under Florida’s DUI law, a person can be arrested for DUI while driving or while in “actual physical control” of a vehicle.

The Key West Police Department said Christina was charged with DUI and refusing to submit to DUI testing. He was taken to the Monroe County Detention Center without incident.

The arrest happened while Christina was off duty. The department’s statement and Local 10’s Sept. 3 report did not include an update on his employment status or the outcome of the charges.
