A man is behind bars after he was accused of sniffing a 9-year-old girl’s buttocks in a Miami Dollar Tree store, police said.
Javan Curry Battle, 32, was arrested Monday on charges of lewd and lascivious conduct on a child and resisting an officer with violence, Miami-Dade jail records showed.
The alleged incident happened while Battle and the 9-year-old, who he doesn’t know, were in the Dollar Tree store at 1043 West Flagler Street, arrest reports said.
Police had responded after the store’s manager had reviewed surveillance footage that showed the suspect putting his face towards the girl’s buttocks area and inhaling, the reports said.
“The victim grabs a poster and begins walking away. The offender again closes the distance between himself and the victim and leans his pelvic area toward the victim’s body,” the report said. “The male appears unable to make contact with the victim as she quickly walks away.”
The girl later told police her mother took her there to buy materials for a school project and her mother had told her to get something from another aisle where she encountered the suspect, who she said touched her around her arm before sniffing her, the report said.
“The victim then described the sensation of the offender smelling her as air on her lower back,” the report said. “The victim stated she knew the offender smelled her so she quickly ran to her mother for safety.”
Officers responded to the store and tried to take Battle into custody but he pushed both officers and tried to run away, the report said.
Battle dragged one officer before he was taken into custody, and both officers were taken to a local hospital, one with a finger sprain and the other for being exposed to Battle’s blood, the report said.
Investigators later spoke with Battle and asked him out the store encounter.
“When questioned about his behavior, the offender stated that he did not intend to cause any harm,” the report said. “He further stated that he placed his face toward the victim’s buttocks because he was under the influence of marijuana and his brain ‘told him to do it.'”
Battle was arrested and booked into jail before he appeared in bond court on Tuesday.
“So, it’s an unusual set of facts,” the prosecutor said during the hearing.
“Nothing here is ever normal,” Judge Mindy Glazer responded, before reading the arrest report. “All I can say is you can’t leave your kid alone for a second. The child was smart and ran to her mother.”
Battle was ordered to stay away from victim and the store, given a curfew from 11 p.m. to 6 a.m., and given house arrest with a GPS monitor or an alternate bond of $2,500.
