FORT PIERCE – Jury questions to Circuit Judge Michael Linn from the panel deliberating a verdict in the Nicholas Mimms felony case showed a sign of fracture Thursday.
A note from the sequestered jury asked about the City of Fort Pierce’s policy and procedures manual, in particular a section on prohibitions on city employees and their families doing business with the city.
Judge Linn said it’s up to jurors to determine what they conclude from the evidence introduced at trial.
A second question asked Judge Linn, “What if we can’t come to an agreement?”
In both cases, Judge Linn responded saying the jury must consider the instructions he gave them and their impression of the evidence that was provided at trial.
The judge and attorneys for both sides found it hard to react to that question because the jury did not make it clear whether they could be deadlocked on a single charge or both bid tampering and official misconduct.
