CAPE CORAL, Fla. (WINK) — A Cape Coral mayoral candidate is threatening a lawsuit against the city to stop a vote on a utilities expansion project.
Lisa Cohen-Adkinson has not filed the lawsuit but says she plans to. She wants to stop the Nov. 2 vote on the Cape Coral North 3 Utilities Expansion Project.
City Council approved the UEP assessments this month. The project aims to replace well water with city water, sewer and irrigation services.
The project could cost homeowners east of Burnt Store Road more than $35,000 in assessments. Those who live on the west side of the road could pay more than $41,000.
Cohen-Adkinson says the timing of the vote being a day before the election is more than just bad timing.
WINK Investigates asked the city manager’s office about the vote. They said they have not received official notification of a lawsuit but provided a statement.
“To further clarify, the City has not been served with any formal Complaint,” the statement said. “Regardless, the City does not comment on pending litigation or any other matters relating to the allegations pertaining to this matter.”
Cohen-Adkinson said her attorneys are reviewing other potential legal action first when asked if she plans to file the lawsuit.
Her opponent, Rick Erickson, issued a statement that says in part, “Announcing an intention to file a lawsuit is different from presenting a filed court case. Once a complaint is filed, residents should be able to review the actual allegations, legal basis, requested relief, case number and court record themselves.”
The city is expected to vote on the UEP on Monday, Nov. 2, a day before the election.
