Cape Coral candidate for mayor Lisa Cohen-Adkinson has filed a lawsuit against the city over issues surrounding the North 3 Utilities Expansion Project.

Filed by the Sabatini Law Firm on Cohen-Adkinson’s behalf, the complaint alleges that the city’s assessment structure would impose approximately $330 million in financial obligations on property owners. The suit states that the structure does not adequately demonstrate that the charges are fairly allocated.

Cape Coral residents have been pushing back against the UEP, citing potential financial strain, as well as the council’s plan to vote on the project assessments the day before November’s general election.

Homeowners east of Burnt Store Road would face approximately $35,264 in assessments, the lawsuit claims, while those west of Burnt Store Road would face around $41,029 in assessments.

The lawsuit demands a review of the assessment methodology and a declaration that any assessments that fail to satisfy the state’s requirements for special benefit and fair apportionment are unlawful, and a prohibition on enforcement of assessments determined to violate the law.
