A 17-year-old is now being charged as an adult in connection with a shooting at an apartment complex in Hialeah last month that prompted a massive police response, records show.

Michael Isaac Delgado, 17, was initially arrested Sept. 2 on two counts of attempted murder and four counts of shooting a deadly missile in the shooting that happened a day earlier at the Aquabella community at 11181 West 35th Way.

He was booked into the Metro West Detention Center on Tuesday to face adult charges that include one count of attempted second-degree murder, one count of shooting a deadly missile and two misdemeanors, records show.

A second suspect, also 17, had been arrested in the incident but it’s unknown whether he’s being charged as an adult.

According to an arrest report, officers had responded to the shooting and stopped a black Tahoe believed to be involved nearby and detained the four males inside.

Officers also found a victim who fled on foot and called 911 who said the four males were his friends and that they had been shot at by another group of males at the apartment complex.

The victim said he and his friends had gone to the complex to meet with Delgado and the other teen to try to resolve an ongoing conflict and said a day earlier, they had agreed to a one-on-one fight, the report said.

He said when they arrived, a physical altercation ensued and at one point Delgado pulled out a gun and shot twice in the air, the report said.

The victim said he started fleeing as Delgado chased after him, saying “Ima kill ya” and firing more rounds in his direction, the report said.

He told police he could hear the bullets passing near his head and body as he fled.

Another victim said Delgado had pointed the gun toward his face and fired in his direction, the report said.

Police said he also fired a round into the Tahoe as three of the victims were trying to flee, and the round penetrated the driver side rear door but didn’t hit any of the victims.

The following day, Delgado and the other teen were found and questioned.

Delgado admitted to having a handgun and shooting once into the air, but said the other teen also shot into the air and into the vehicle, the report said.

The other teen only admitted to shooting once into the air, the report said.

Delgado appeared in adult court Wednesday, where he was ordered held without bond.

“It’s definitely disappointing, we were hoping that the state attorney’s office would consider the mitigation evidence that we presented,” his defense attorney, Omar Lopez, said after Wednesday’s hearing. “The mitigation evidence shows that this was a mutual fight that escalated. And the other boys that were involved also brought guns. We showed the state attorney’s office that at least one of the gentlemen on the other side has pictures of himself with guns, despite that the state attorney’s office decided that they wanted to go forward on the adult side.”

Lopez said his next step is to seek Delgado’s release.

“My next step is to ask for a hearing, and during that hearing I will ask the court to consider sending him home,” he said. “He’s 17 years old. This is his first contact with the adult system, obviously, perhaps on some ankle monitor and total lockdown.”
