An 18-year-old Cape Coral man was arrested Monday after police said he grabbed a teenage girl and confronted a school employee during a high school football game. Investigators say the confrontation unfolded at Cape Coral High School on Oct. 29, when an officer working security intervened after the man allegedly grabbed the girl and later shoved a staff member.

According to Gulf Coast News and Weather, the officer working security said he saw the man block the girl from walking away before grabbing her arm. The school employee later told police that the same man pushed him in the chest before running away from the area.

Officer Says Man Fled Despite Warning

The officer said he chased the man and ordered him to stop while holding a stun gun, but the man kept running, according to the police account relayed in the report. He continued running even after the officer’s command to halt, the report states.

Investigators said the school employee had a red mark on his chest following the incident and told police he wanted to press charges. Police also listed a photo of the employee’s injury among the evidence gathered in the case.

Police Later Identified the Suspect

Investigators said school video, a statement from the teenage girl, and a GoFan ticket record — the digital ticketing system used for the game — helped them identify the man as Ernesto Javier Frenes Oviedo, 18. He was arrested Monday in Cape Coral.

Police said the teenage girl and her parent had not decided whether to pursue a battery charge related to the arm-grabbing allegation, leaving that piece of the case unresolved for now.

Charges and Next Court Date

Frenes Oviedo faces battery on a public education employee, a third-degree felony; assault on a public education employee, a first-degree misdemeanor; and resisting an officer without violence, a first-degree misdemeanor, according to police. Florida law addressing battery on school staff is outlined under Chapter 784 of the Florida Statutes.

Frenes Oviedo is scheduled to appear in court on Dec. 7. No additional details about his attorney or a plea were available.
