Port St. Lucie police are investigating the death of 6-year-old Emma Riddle, who died following a go-kart accident at Urban Air Adventure Park on Saturday night.WPBF 25 News obtained the 911 call from inside the park.A woman tells the 911 dispatcher that a child was injured.”They were in a go-kart accident. Someone hit them from behind,” the woman said. “She hit her sternum really hard. She’s kind of incoherent. I think we need a medic right away.”The family identified the girl as 6-year-old Emma Riddle.She died Sunday at the hospital.Port St. Lucie police have not yet said who, if anyone, they believe is to blame.”Even if the proprietor did everything that they can do to prevent the injury, they can still potentially be held liable,” said Tayson Gaines.Gaines is an attorney in North Palm Beach.He is not involved in this case but has handled similar cases in the past.Gaines noted that Urban Air requires clients to sign a waiver that says, in part, that customers “are giving up your child’s right and your right” to sue, even if the fault lies with the park.”They say even if it’s a defective product or a defective design, your claims to that would be written out,” Gaines said.Gaines emphasized that all businesses like Urban Air have similar waivers, but there are ways to challenge them in court. He advised parents to always know what they’re signing.”Read anything before you sign. Try to negotiate anything you don’t like, or you think is a risk for you. Ask questions,” Gaines said.Emma Riddle’s family is holding a memorial service for her on Saturday at 10 a.m. at Calvary Church in Port St. Lucie, and the public is invited to attend.
