Derek Rosa, a Hialeah (at the time) 13-year-old, has accepted a plea deal after being accused of murdering his mother in her bedroom. Rosa confessed to the fatal stabbing in his mother’s bedroom as her newborn baby slept nearby. The plea agreement involves Rosa pleading guilty to second-degree murder (he was charged with first-degree murder) and serving 25 years in prison. He’ll also serve 20 years of probation after leaving prison.

Rosa stabbed his mother, Irina Garcia, more than 40 times while she was sleeping. The baby was unharmed.

The state has a 911 call recording they say he made after the stabbing confessing to the murder. Police read Rosa his Miranda rights at the time, which he waived, but his attorneys argue he was too young to waive his Miranda rights.
