ORLANDO, Fla. — Orlando Police Department investigators say a substitute teacher has been charged criminally after several students accused him of acting inappropriately during class.

Four students were interviewed by an Orlando Police Department detective on Oct. 10, after they told a school resource officer that they allegedly saw Huerta with an erection (under his clothing), touching his genitals (over his clothing) and looking at nude photos on his phone, all while he was in a classroom full of students the day before.
According to court documents, a 13-year-old student told the detective that some students saw nude photos on Huertas’ phone, but that “non of the girls saw faces in the photos or were able to truly differentiate what exactly was on the phone.”
Another student told the detective that she specifically saw the substitute scrolling through photos on his phone that showed a “female’s boobs, bottom, and ‘front part.'”
When he spoke to the detective, Huerta reportedly said he had been looking at Instagram on his phone, and claimed the photos could have been of a woman in a bikini that showed up while he was scrolling.
A third student, a 12-year-old girl, accused Huerta of putting his hand down his pants and moving it “in an up and down motion.”
While all four students said they saw Huerta with an erection under his pants — and all but one said they saw him touching himself over his clothes — none of them accused the substitute of exposing himself.
When contacted by the detective on Oct. 16, Huerta reportedly said it is “usual for him to become aroused randomly throughout the day,” and that it was possible the students saw him “tucking his erection, hiding his erection, or rubbing his erection.”
‘Huerta eventually stated, ‘I rubbed the erection. I do remember rubbing it. I did all three,'” an affidavit in the case said.
Later that day, the detective reported that she visited Huerta’s residence and was able to recover the clothes the substitute was wearing on Oct. 9 and put them into evidence.
Huerta told the detective that he has been working for Kelly Education as a substitute teacher since December 2024, and currently also works for SeaWorld. He said he previously worked as a busser at Disney World, but was told by a manager that “the job was not the right fit for him due to him not working fast enough.”
The Orange County Clerk of Courts website does not currently say when Huerta’s next court appearance will be. He is not listed as currently incarcerated on the Orange County Jail’s website.
