Two of the three young suspects facing charges in the alleged rape of a 12-year-old girl at a community garden in Miami last year were back in court Monday where a judge denied bond for one and granted house arrest for the other.

Nelson Nunez, 13, was denied bond and will stay in jail while he awaits trial, while 12-year-old Jusiah Jones was granted house arrest.

Nunez, Jones and 15-year-old Xavier Tyson are all charged as adults in the alleged rape that happened June 18, 2025, records show.

According to police, the victim told investigators she was taken to the Green Haven Project at 1160 Northwest 2nd Avenue, a community garden in Overtown, by the group of boys before she was held down and prevented from screaming when rocks were forced into her mouth.

While Jones and Tyson allegedly held the young girl down, Nunez raped her, arrest reports said.

A grand jury indicted the boys on various charges, including kidnapping & false imprisonment.

In asking to be released, Jones’s attorney claimed he was pressured into participating in the assault by the other teens.

An attorney for Nunez also sought his release, saying he admitted to the crime, he was remorseful, and his family was willing to welcome him home to take care of him.
