Murder charge dropped against man accused in deadly shooting outside Orlando nightclub

ORLANDO, Fla. – Jean Gabriel Borja Gil De La Madr, the man charged in a deadly shooting outside an Orlando nightclub, is no longer facing charges of second‑degree murder with a firearm.

According to documents obtained by News 6, prosecutors could not “prove beyond a reasonable doubt use of force was not justified.”

In February, Jean Gabriel Borja Gil De La Madr was arrested and accused of killing Julien Emmanuel Cruz outside Savoy Orlando on North Orange Avenue.

Police said Cruz and Borja Gil De La Madr were involved in a verbal and physical altercation on the sidewalk before the shooting. During the confrontation, Borja Gil De La Madr retrieved a firearm from his vehicle and shot Cruz, who later died at the hospital.

Borja Gil De La Madr fled the scene, but was eventually arrested.

Borja Gil De La Madr’s attorney contested that the shooting was self-defense.
