LEE COUNTY, Fla. (WINK)—An expensive e-bike trap exists that could catch you even if you’ve never touched one.
Lee and Marcia Wiggins came to WINK Listens with several concerns about e-bikes. Among them, Wiggins said riders should have insurance.
But legal e-bikes in Florida are not motor vehicles, which means the owner doesn’t need to have any insurance. The question of who pays for your damages becomes more relevant after cases like one near Miami, where a 15-year-old on an electric dirt bike hit an elderly couple.
“The fact that this happened to us is insanity, craziness,” the couple said.
WINK News wanted to look at this from two different angles: if you’re hit by an e-bike and if you have one, are you insured and protected? Attorney Robert Goodman explained the coverage options.
“So if you’re in a vehicle and you’re hit by an e-bike and you have uninsured motorist coverage, which is an option on your policy, then that should cover you,” Goodman said. “But it depends on how it’s worded.”
Making sure you have that coverage is key, which costs extra but should be on your auto policy unless you specifically declined it when you first bought your policy. It matters because, as the Lee County Sheriff’s Office confirmed for WINK News, if an e-bike driver causes a crash, it would be up to them to cover damages.
“I feel like there has to be responsibility for this situation,” the Miami couple said.
If they can’t pay or won’t, you’d have to sue or more likely make a claim on your policy for a wreck with an uninsured motorist. Wiggins shared her own experience with an uninsured driver.
“I was involved in an accident with an uninsured driver, and you know it was all up to me then because he had no insurance,” Wiggins said. “He was going to go into the service, and it was a difficult time, and it was expensive for me.”
If you have an e-bike, a legal one that goes 28 mph or less, you can usually get liability coverage very cheaply. An insurance agent said you might have to ask for it, with some policies as little as $60 a year.
That will help protect you if you cause a wreck on your e-bike, an important consideration for riders and parents with kids who ride e-bikes to help protect your assets like your home.
