PORT ST. LUCIE, Fla. (CBS12) — A traveling MRI technician accused of sexually assaulting a patient at HCA Florida St. Lucie Hospital allegedly told her, “Nobody can see what I can do to you,” before bringing her into an MRI room, according to a Port St. Lucie Police report.
CBS12 News previously reported the arrest of Gabriel Cruz, 42, a traveling MRI technician accused of sexually assaulting a patient at HCA Florida St. Lucie Hospital. He faces a first-degree felony charge of sexual battery involving a physically helpless or incapacitated victim.
“In this case our victim was pretty aware of what was going on. She was just not physically able to do much about it. She woke up while the act was occurring,” said Leo Niemczyk, Port St. Lucie Police Chief.
The criminal complaint says on Sept. 14, shortly after 8 a.m., officers responded to HCA Florida St. Lucie Hospital after a patient reported that a technician had sexually assaulted her, the report states.
Officers met with the hospital’s director of patient safety, who said the patient reported being sexually assaulted by a male Hispanic imaging technician during the time of her MRI.
The patient told investigators that Spanish is her primary language and that she had been admitted to the hospital after experiencing fainting spells and two falls that caused her to hit her head.

According to the report, the patient was transported from her room for an MRI at about 4 p.m. on Sept. 13. She said medication made her drowsy and that she drifted in and out of sleep. She described the technician as a Hispanic man with a medium build who spoke Spanish and wore a blue shirt.
The patient told police that after the MRI, she fell asleep. When she woke up, she alleged the technician had sexually assaulted her and was rubbing her hair. The report states that he then cleaned her mouth with a white towel. Another person later transported the patient back to her room.
Hospital staff identified the technician as Gabriel Cruz, a traveling technician who had been under contract at the hospital since August, according to the report.
“Often times when you see this type of behavior it may not have been their first time, right? So we always have to be aware that there may be other victims out there,” Chief Niemczyk said.
Police said surveillance video does not show inside the MRI room because there are no cameras there. However, the report states the video showed that Cruz was the only person in the room with the patient during that time.
We spoke with a local rape crisis counselor about the impact of something like this.
“It is a very confusing time for people. It can bring upon people feeling ashamed, they can feel fearful, confused, guilty, angry. They can have difficulty relating with people close to them after the fact,” said Julie Stoyka, Director, Sexual Assault Assistance Program of the Treasure Coast and Okeechobee. Their rape crisis helpline is staffed 24 hours a day, seven days a week. 866-828-7273.
“It was just particularly troubling because it was a vulnerable person who was under sedation and it was in a hospital setting and we all want to feel safe when we’re in a hospital. But, you know, truly you’re not safe anywhere,” Chief Niemczyk said.
HCA Florida St. Lucie Hospital released a statement that says:
We do not tolerate behavior that jeopardizes the safety or security of our patients. When this serious allegation was reported to us, we contacted law enforcement and ended the individual’s assignment. We have assisted law enforcement throughout its investigation and remain focused on supporting our patient.
