Darryl Kogan, a retired personal injury attorney in Boca Raton, has been charged with trying to view child sexual abuse images.

On Friday, the 68-year-old Kogan signed an indictment waiver and “consented to prosecution by information” after being informed that he has been accused of at least one offense.

In Fort Lauderdale, Magistrate Judge Jared Strauss set his bail at $250,000 and ordered him to surrender his passport, remain in South Florida, avoid firearms and avoid all contact with victims or witnesses.

On Thursday, prosecutors in the Southern District of Florida submitted a one-page, one-count charging document of attempted receipt of visual depictions involving the sexual exploitation of a minor. The agreement was co-signed by his niece, Samantha Kogan.

If convicted, he faces a potential prison sentence of between five and 20 years.

The filing reads, “On or about February 18, 2026, in Broward County, in the Southern District of Florida, and elsewhere, the Defendant, DARRYL KOGAN, did knowingly attempt to receive any visual depiction, using any means and facility of interstate and foreign commerce, and that had been shipped and transported in and affecting interstate and foreign commerce, by any means, including by computer, and the production of such visual depiction involved the use of a minor engaged in sexually explicit conduct, as defined in Title 18, United States Code, Section 2256(2), and such visual depiction was of such conduct, in violation of Title 18, United States Code, Section 2252(a)(2) and (b)(1).”

The arrest affidavit has not been entered into the court system.

Kogan retired earlier this year.

He co-founded Kogan & DiSalvo in 1994. The firm changed its name to Baker & DiSalvo this year.

A spokesperson with the firm wrote in a statement to WPBF:

“We had no knowledge of this federal charge until yesterday. It is deeply upsetting and given that we were unaware of the allegation or the case, we are unable to comment further.

“Mr. Kogan was already moving toward retirement, when three months ago, he accelerated the timeline, simply citing personal reasons. He no longer has any affiliation with the firm. Over the past few months, we have been transitioning our staff, advertising, and communications to reflect our new leadership at Baker & DiSalvo. Our focus remains on our clients and fighting for everything they deserve.”

The law firm has several locations in Florida.

The Florida Bar website shows he is “permanently retired” and “not eligible to practice law in Florida.”

His practice areas were civil litigation, personal injury, product liability and trial.

His mailing address is listed as being in Los Angeles.

Kogan attended the University of Miami School of Law and was admitted to the Florida Bar in 1983.
