  • October 15, 2026

TALLAHASSEE, Fla. (WCTV) – A man accused of shooting and killing a man just before burning his body in southwest Leon County in August was indicted Wednesday on new charges, according to court records.

Luis Olla-Hernandez, 29, was indicted on his initial charge of first-degree murder, along with new charges of two counts of armed sexual battery, kidnapping to facilitate a felony, and tampering with physical evidence, according to court documents.

The court papers did not detail what led to the new charges. However, it indicated the crimes happened in the same time period as the deadly August incident.

The new indictment comes nearly two months after Olla-Hernandez was arrested for allegedly shooting and killing Devin Graves, just before burning Graves’ body with the help of his girlfriend, Olla-Hernandez’s arrest papers revealed.

The probable cause affidavit went on to reveal that the murder happened in the 200 block of Pond Pine Street back in August, where authorities said Olla-Hernandez lived in a converted shed.

Olla-Hernandez suspected that Graves was involved with his girlfriend, which detectives said led him to lure the victim to his property.

The suspect allegedly shot Graves multiple times after he entered his shed and forced his girlfriend at gunpoint to help clean up and dispose of the victim’s body, including burning the remains on the property, per court papers.

The remains were found a couple of days later in a fresh burn pile at the suspect’s property, the affidavit wrote.

Court documents WCTV obtained in August revealed that U.S. Immigration and Customs Enforcement issued an immigration detainer for Olla-Hernandez, indicating ICE planned to detain the suspect.

The records also stated that the suspect is an El Salvador citizen and identified him as “a member of a designated foreign terrorist organization” or “otherwise poses a risk to national security, border security or public safety.”

Olla-Hernandez was initially ordered to be removed by a judge in 2024 after illegally entering the U.S. near Texas, according to an ICE spokesperson.

WCTV spoke with a member of Graves’ family, who said his loss was shocking. “Everyone involved needs to be held accountable and we just need justice for Devin,” she said.
