Ask a friend for advice and the familiar response is \u201cI don\u2019t know anything about<br \/>probate, you need a lawyer.\u201d However, that\u2019s not always true.<\/p>\n<p>You might be able to handle it yourself, depending on your loved one\u2019s assets. Enter Do-It-<br \/>Yourself Probate. (courtesy, 17th Judicial Circuit)<\/p>\n<p>According to the <a href=\"https:\/\/hdpulse.nimhd.nih.gov\/data-portal\/mortality\/table?age=001&amp;age_options=age_11&amp;cod=247&amp;cod_options=cod_15&amp;comparison=counties_to_us&amp;comparison_options=comparison_counties&amp;race=00&amp;race_options=race_6&amp;ratetype=aa&amp;ratetype_options=ratetype_2&amp;ruralurban=0&amp;ruralurban_options=ruralurban_3&amp;sex=0&amp;sex_options=sex_3&amp;statefips=12&amp;statefips_options=area_states&amp;yeargroup=5&amp;yeargroup_options=year5yearmort_1&amp;county=12000&amp;county_options=counties_florida&amp;radio_comparison=areas&amp;radio_comparison_options=cods_or_areas\" rel=\"nofollow noopener\" target=\"_blank\">National Institutes of Health<\/a>, more than 17,000 people die in Broward<br \/>County each year. Many more declare Broward their home for tax estate purposes, meaning<br \/>their probate occurs here too \u2014 suffice it to say, probate judges in the 17th Judicial Circuit are<br \/>extremely busy. Broward\u2019s three probate judges currently handle more than 14,000 cases and many involve large estates, complex issues, extensive attorney fees, and take years to resolve.<\/p>\n<p>The good news is that a person whose estate is too small to justify hiring a lawyer, but still needs to access a loved one\u2019s bank account to pay for the funeral, transfer title to a car, receive retirement benefits, or determine who has rights to the house now has a do-it-yourself option that can save money and time.<\/p>\n<p>Now, pro se litigants \u2014 individuals representing themselves in probate matters \u2014 can have their case assigned to a division that is staffed by magistrates who specifically allocate time to handle<br \/>smaller probate issues. While the magistrate cannot provide legal advice, they can steer your case<br \/>in the right direction, which is the goal for a pro se litigant. This option is called \u201csummary<br \/>probate,\u201d and it can be used in instances where someone died more than two years ago or if the<br \/>individual\u2019s assets are worth less than $75,000.<\/p>\n<p>Here\u2019s how it works: A pro se litigant files a petition with the court for \u201csummary administration\u201d<br \/>that includes a detailed checklist for things like proof of payment for funeral and medical costs,<br \/>names of beneficiaries, creditor claims and whether or not real property is involved.<\/p>\n<p>Next, the clerk of courts reviews the submission and assigns it to a general magistrate. The case<br \/>plays out in one of two ways: A magistrate reviews the case, determines everything is in order<br \/>and OKs the distribution of assets, or the magistrate sets a hearing to clarify unanswered<br \/>questions so the case can move forward.<\/p>\n<p>\u201cHaving magistrates who dedicate time to a pro se probate docket to assist the general public<br \/>improves case management,\u201d said Chief Judge Carol-Lisa Phillips. \u201cThis greatly reduces the<br \/>backlog of pro se probate cases previously assigned to judges who are usually busy with their<br \/>contested motion calendar docket and trial calendar.\u201d<\/p>\n<p>Fort Lauderdale resident Allyson Meyers used DIY probate and saved $5,000 to $10,000.<br \/>\u201cRegular status updates with the clerk\u2019s office ensured the paperwork was in order and helped<br \/>keep the process on track,\u201d she reported.<\/p>\n<p>Summary administration saves time and money by eliminating the need to submit an extensive<br \/>formal inventory, publish notice over an extended time, pay lawyers hefty fees and wait months<br \/>or years for the probate to conclude. Just remember, this option is not for large, complex estates.<br \/>However, if your case qualifies, you can access the forms you need online to file your own<br \/>probate case and save time and money.<\/p>\n<p>Need some guidance?
