Can it help against financial abuse?"},"content":{"rendered":"\n<p class=\"yf-vbsvxt\">It\u2019s a story that\u2019s all too common these days: an elderly person gets <a href=\"https:\/\/moneywise.com\/news\/top-stories\/houston-woman-78-died-terrified-of-losing-her-home-after-signing-a-138k-solar-contract-she-didnt-understand?utm_source=syn_oath_mon&amp;utm_medium=WL&amp;utm_campaign=155407&amp;utm_content=syn_ca8e8d8e-8a42-4223-957f-275a819a4bf7\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:roped into a sales contract they don\u2019t fully understand;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">roped into a sales contract they don\u2019t fully understand<\/a> and ends up paying far more than they thought they would.<\/p>\n<p class=\"yf-vbsvxt\">Now, a Florida senator has proposed a bill designed to protect the state\u2019s <a href=\"https:\/\/moneywise.com\/news\/91-year-old-sacramento-woman-was-able-to-finance-solar-panels-shed-pay-off-at-age-of-114?utm_source=syn_oath_mon&amp;utm_medium=WL&amp;utm_campaign=155407&amp;utm_content=syn_0ada1420-e81d-4659-9178-448dba9b0992\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:most vulnerable residents;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">most vulnerable residents<\/a> from the same thing happening to them.<\/p>\n<p class=\"yf-vbsvxt\">Sen. Ileana Garcia\u2019s \u201cElderly and Disabled Adult Contract Protection Act\u201d was introduced on Jan. 13. It would require contracting parties to record a video that depicts them conducting a \u201ccomprehensive review\u201d of contract terms with the elderly or disabled adult, as well as the signing of the contract \u2014 and store that recording for at least five years. The bill defines \u201celderly\u201d as someone aged 60 and older.<\/p>\n<p class=\"yf-vbsvxt\">The goal is to ensure older Americans fully understand what they\u2019re agreeing to when purchasing a product or service, thereby reducing cases of financial exploitation, misleading sales tactics and pressured consent.<\/p>\n<p class=\"yf-vbsvxt\">The proposed legislation could fundamentally change how contracts are enforced and challenged when older residents claim to be misled.<\/p>\n<p class=\"yf-vbsvxt\">\u201cOut of the blue, I thought, what a great idea, so many agreements are signed under cover of dark,\u201d attorney Charles Gallagher III told Tampa Bay 28 in a story that aired Jan. 8 (1). \u201cThe law in Florida doesn\u2019t really help folks in that context. The law in Florida presumes if you signed the contract, you understand it.\u201d<\/p>\n<p class=\"yf-vbsvxt\">But even Gallagher, despite his initial excitement, has practical concerns. Do these all require a video?\u201d<\/p>\n<p class=\"yf-vbsvxt\">He also worried about operational impact, noting law firms, insurance companies, real estate agencies and many other Florida businesses could slow down their practices.<\/p>\n<p class=\"yf-vbsvxt\">And, crucially, the bill might not prevent all exploitation. It only requires documentation of the process and by itself doesn\u2019t provide the means to void contracts, ban predatory tactics or create a cooling-off period for seniors to reconsider.<\/p>\n<p class=\"yf-vbsvxt\">The proposed bill appears unique in requiring video-recorded contract reviews specifically for elderly protection. While all states have Adult Protective Services programs and elder abuse statutes, few have implemented preventive measures specifically targeting the contract-signing process itself.<\/p>\n<p class=\"yf-vbsvxt\">According to SeniorSite&#8217;s analysis of state elder abuse laws, 15 states mandate that all citizens report suspected elder abuse, while others limit reporting requirements to specific professionals (2).<\/p>\n<p class=\"yf-vbsvxt\">Financial exploitation penalties vary dramatically. For example, North Carolina classifies financial exploitation above $100,000 as a Class F felony, while physical abuse resulting in serious injury is a Class G felony. On the other hand, Michigan has a four-tier system for physical elder abuse with penalties from misdemeanors to felonies requiring prison time of up to 15 years.<\/p>\n<p class=\"yf-vbsvxt\">Americans aged 60 and up are among the most vulnerable to scams and exploitation. Even if the Florida bill doesn\u2019t pass this legislative session, it signals growing recognition that existing contract laws don\u2019t adequately protect vulnerable adults.
