{"id":12448,"date":"2025-10-20T15:29:09","date_gmt":"2025-10-20T15:29:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/12448\/"},"modified":"2025-10-20T15:29:09","modified_gmt":"2025-10-20T15:29:09","slug":"u-s-supreme-court-refuses-to-hear-challenge-to-floridas-closed-primaries-2","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/12448\/","title":{"rendered":"U.S. Supreme Court refuses to hear challenge to Florida\u2019s closed Primaries"},"content":{"rendered":"<p style=\"text-align: justify;\">Among the dozens of petitions the U.S. Supreme Court\u00a0<a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/101425zor_8m58.pdf\" target=\"_blank\" rel=\"noopener external noreferrer nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.supremecourt.gov\/orders\/courtorders\/101425zor_8m58.pdf&amp;source=gmail&amp;ust=1760819028199000&amp;usg=AOvVaw1R8L6e_U5koMjuivLOht7y\" data-wpel-link=\"external\">rejected<\/a> this week was one from a Sarasota resident who challenged Florida\u2019s closed Primary system.<\/p>\n<p style=\"text-align: justify;\">Michael J. Polelle is a former lawyer and emeritus professor at the University of Illinois Chicago School of Law. An independent voter, he was upset after moving to Sarasota in 2012 and learning that as a no-party voter, he was shut out of County Commission Primaries because of the state\u2019s closed system.<\/p>\n<p style=\"text-align: justify;\">Florida is one of a\u00a0<a href=\"https:\/\/floridaphoenix.com\/briefs\/survey-says-florida-dems-and-npa-voters-support-open-primary-elections\/\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/floridaphoenix.com\/briefs\/survey-says-florida-dems-and-npa-voters-support-open-primary-elections\/&amp;source=gmail&amp;ust=1760819028199000&amp;usg=AOvVaw1-XIz15imTWzabYckLo4rc\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">minority of states<\/a> with closed Primaries. That system locks out the nearly 3.4 million Floridians registered as no-party voters, as well as 443,000 more who are registered with a minor political party \u2014 more than 28% of the electorate.<\/p>\n<p style=\"text-align: justify;\">In a phone interview this week, Polelle, 87, told the Phoenix that while he was bothered by not being able to vote in the Primaries in 2012, he wasn\u2019t willing to do anything about it at the time. But he said his feelings changed after the 2016 election, when he realized how \u201cfragile\u201d the election system was, and how it gravitates towards polarization.<\/p>\n<p style=\"text-align: justify;\">\u201cBut then what really struck me is that I never realized that my real estate taxes go to pay for these Primaries that I can\u2019t vote in. And that makes no sense to me,\u201d he said.<\/p>\n<p><a href=\"https:\/\/www.shutts.com\/\" target=\"_blank\" rel=\"noopener external noreferrer nofollow\" data-wpel-link=\"external\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-740415 size-full\" src=\"https:\/\/www.newsbeep.com\/us-fl\/wp-content\/uploads\/2025\/10\/FLPolitics-May-2025-728x90-1-scaled-e1748483753690.jpg\" alt=\"\" width=\"728\" height=\"90\"\/><\/a><\/p>\n<p style=\"text-align: justify;\">Without the aid of a law firm but with assistance from some of the legal contacts he\u2019s maintained in Chicago, he filed a lawsuit in 2022 in the U.S. Middle District Court of Florida challenging the state\u2019s ban on open Primaries, saying it violates his rights under the First Amendment and equal protection clause to political free speech and association. Florida Secretary of State Cord Byrd and Sarasota County Supervisor of Elections Ron Turner were listed as defendants.<\/p>\n<p style=\"text-align: justify;\">U.S. District Judge Steven D. Merryday dismissed the case in November 2022, ruling that Polelle lacked standing and had failed to state a claim for relief. Merryday also found that Florida\u2019s interest in preventing unaffiliated voters\u2019 potential to undermine a political party\u2019s candidate-selection process outweighed his desire to vote in a partisan Primary, especially given the minimal burdens that Florida law imposes on voters who wish to join or switch political parties.<\/p>\n<p style=\"text-align: justify;\">He then filed an appeal last year with the U.S. Circuit Court of Appeals for the Eleventh Circuit. In an\u00a0<a href=\"https:\/\/media.ca11.uscourts.gov\/opinions\/pub\/files\/202214031.pdf\" target=\"_blank\" rel=\"noopener external noreferrer nofollow\" data-wpel-link=\"external\">112-page ruling<\/a> released in March, a three-Judge panel rejected his arguments.<\/p>\n<p style=\"text-align: justify;\">The ruling said that Polelle had \u201cboth the right to a meaningful vote and the right not to be associated with certain political groups and messages. And Florida\u2019s closed primary burdens those rights.\u201d They added that \u201cFlorida\u2019s system of closed primary elections may put Polelle to a \u2018Hobson\u2019s Choice,\u2019 but it does not do so unconstitutionally.\u201d<\/p>\n<p style=\"text-align: justify;\">Two of the three Judges did write that Polelle had standing to sue the Sarasota County Supervisor of Elections, which Polelle considers \u201ca big win, because prior cases said that people like me, who are not affiliated with a party, don\u2019t even have rights to sue.\u201d<\/p>\n<p><a href=\"https:\/\/www.jaytrumbull.com\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-723469\" src=\"https:\/\/www.newsbeep.com\/us-fl\/wp-content\/uploads\/2025\/10\/jay-trumbull-florida-politics-banner-ads-728x90-b-scaled-e1740688220698.jpg\" alt=\"\" width=\"728\" height=\"90\"\/><\/a><\/p>\n<p style=\"text-align: justify;\">He petitioned for the U.S. Supreme Court to hear the case, with the Independent Voter Project, Open Primaries and the Forward Party filing a joint <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-147\/373997\/20250908133401736_25-147%20Brief.pdf\" target=\"_blank\" rel=\"noopener external noreferrer nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-147\/373997\/20250908133401736_25-147%2520Brief.pdf&amp;source=gmail&amp;ust=1760819028199000&amp;usg=AOvVaw1DyQ5qLzCz0o_Oq2WNrAqo\" data-wpel-link=\"external\">amicus brief<\/a>\u00a0in support of his lawsuit, which was denied earlier this week.<\/p>\n<p style=\"text-align: justify;\">Polelle cited in his legal brief that polls show there are more voters who call themselves independent than do a Republican or Democrat.\u00a0<a href=\"https:\/\/news.gallup.com\/poll\/15370\/party-affiliation.aspx\" target=\"_blank\" rel=\"noopener external noreferrer nofollow\" data-wpel-link=\"external\">A 2024 Gallup survey<\/a>\u00a0showed that 43% of Americans considered themselves independents, with 28% calling themselves Democrat and 28% Republican.<\/p>\n<p style=\"text-align: justify;\">Meanwhile, the Florida Democratic Party is engaging in\u00a0<a href=\"https:\/\/floridaphoenix.com\/2025\/07\/11\/florida-democratic-party-is-considering-opening-its-primaries-to-npa-voters\/\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/floridaphoenix.com\/2025\/07\/11\/florida-democratic-party-is-considering-opening-its-primaries-to-npa-voters\/&amp;source=gmail&amp;ust=1760819028199000&amp;usg=AOvVaw1258K1jhsBvm7dhDb-yuXb\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">an internal discussion<\/a> about whether to open future Primaries to no-party voters. Polelle said he received an email from Florida Democratic Party Chair Nikki Fried as his lawsuit was pending, and also heard from Mitchell Berger, an attorney with the party, who asked to see his legal briefs.
