{"id":135837,"date":"2026-01-29T02:58:06","date_gmt":"2026-01-29T02:58:06","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/135837\/"},"modified":"2026-01-29T02:58:06","modified_gmt":"2026-01-29T02:58:06","slug":"attorney-for-child-slammed-by-jso-officer-at-skate-park-calls-for-upgraded-charges-2","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/135837\/","title":{"rendered":"Attorney for child slammed by JSO officer at skate park calls for upgraded charges"},"content":{"rendered":"<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">JACKSONVILLE, Fla. \u2013 An off-duty officer with the Jacksonville Sheriff\u2019s Office is facing misdemeanor battery charges after an incident at a Jacksonville Beach skate park, where he slammed a child to the ground. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The incident was <a href=\"https:\/\/www.news4jax.com\/news\/local\/2026\/01\/21\/witnesses-give-insight-into-altercation-with-off-duty-jso-officer-and-kid-on-e-bike-at-skate-park\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.news4jax.com\/news\/local\/2026\/01\/21\/witnesses-give-insight-into-altercation-with-off-duty-jso-officer-and-kid-on-e-bike-at-skate-park\/\">caught on surveillance video and has sparked public outrage<\/a>.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The veteran officer, Stephen D. Hicks, was seen forcefully pulling a child off an e-bike and taking him to the ground. The video initially made the man appear to be a bystander, but he was later identified as a law enforcement officer.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Shannon Schott, an attorney with Plata Schott Law representing the child\u2019s family, described the incident as \u201cextremely horrifying.\u201d <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cAs a parent of a child who regularly goes to Sunshine Park, I was just very disturbed that a grown adult would pull a child off an e-bike and slam him to the ground in such a forceful manner,\u201d she said.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Schott is advocating for upgraded charges against Hicks, including felony child abuse. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cWe\u2019re really hopeful that the clerk and the state attorney\u2019s office will consider additional charges and consider making sure that this family has all of the protections of Marcy\u2019s law, which is the constitutional right of the family to be protected as victims,\u201d she said.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The attorney <a href=\"https:\/\/www.news4jax.com\/news\/local\/2026\/01\/28\/jso-officers-actions-were-unprovoked-egregious-says-attorney-for-child-who-was-tackled-off-e-bike-at-skate-park\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.news4jax.com\/news\/local\/2026\/01\/28\/jso-officers-actions-were-unprovoked-egregious-says-attorney-for-child-who-was-tackled-off-e-bike-at-skate-park\/\">called the officer\u2019s actions \u201cunprovoked\u201d and \u201cegregious,\u201d<\/a> adding that they violated both policy and the child\u2019s rights. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cThis was obviously a very scary interaction,\u201d Schott said. \u201cIt\u2019s made worse by the fact that the defendant in this case, the assailant, has a position of power and could use that position of power against the victim and his family. They\u2019re in fear, they\u2019re very afraid.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The incident took place at South Beach skate park, where signs clearly prohibit e-bikes on the grounds. Schott said the situation could have been handled differently and that the family is now considering felony charges against Hicks.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cWe\u2019ve officially filed our notice of appearance pursuant to Marcy\u2019s law in the criminal case, which I intend to appear at the hearing that is coming up in February,\u201d Schott said. \u201cWe also will file a statement of claim and a notice of representation to Mr. Hicks and to the Jacksonville Sheriff\u2019s Office.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Hicks\u2019 attorney told News4JAX that his client acted out of fear that someone would be seriously injured by teenagers riding what he called \u201celectric motorcycles\u201d through the park. Schott disagrees with that explanation.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cIf he was truly doing the right thing and investigating in his capacity as a law enforcement officer, he would not have left the scene,\u201d she said. \u201cHe would have worked with the Jacksonville Beach Police in order to investigate any alleged crimes that occurred. But the reality of the situation is that he was in the wrong.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Hicks has pleaded not guilty to the charges and bonded out of jail last week. He is scheduled to appear in court on Feb. 17.
