{"id":140266,"date":"2026-02-02T04:05:12","date_gmt":"2026-02-02T04:05:12","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/140266\/"},"modified":"2026-02-02T04:05:12","modified_gmt":"2026-02-02T04:05:12","slug":"homeowners-want-restitution-from-mv-realtys-3-million-judgment","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/140266\/","title":{"rendered":"Homeowners want restitution from MV Realty\u2019s $3 million judgment"},"content":{"rendered":"<p>Florida&#8217;s attorney general secured this court judgment after accusing the company of a \u201ccomplex and deceptive scheme\u2026 swindling consumers out of their home equity.&#8221;<\/p>\n<p>TAMPA, Fla. \u2014 Homeowners who claim they were deceived by a South Florida brokerage say they want restitution from a $3 million court-ordered judgment in the attorney general\u2019s case against <a href=\"https:\/\/www.wtsp.com\/article\/news\/investigations\/10-investigates\/mv-realty-settles-with-florida-attorney-general-avoids-trial\/67-f8e7973f-afa9-4ccc-a0a8-b12caee41e9c\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">MV Realty<\/a>.\u00a0<\/p>\n<p>The Florida Office of the Attorney General secured this judgment in December after a three-year lawsuit where the state accused the company of a \u201ccomplex and deceptive scheme\u2026 swindling consumers out of their home equity.\u201d<\/p>\n<p>RELATED | <a href=\"https:\/\/www.wtsp.com\/article\/news\/investigations\/10-investigates\/mv-realty-ends-40-year-contracts-florida\/67-03eae322-db6a-4ac4-a67c-d6d09685e4cd\" class=\"cms__embed-related-story__link\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">MV Realty clears controversial 40-year contracts for all Florida homeowners, state says<\/a><\/p>\n<p>At the center of the lawsuit were MV Realty\u2019s Homeowner Benefit Agreements, which paid homeowners up to a few thousand dollars for exclusive listing rights. However, the contracts were for 40 years and filed as a memorandum in public records. The state alleged those filings acted like liens.<\/p>\n<p>A Hillsborough County judge ruled last year that the contracts were \u201cunconscionable,\u201d making them \u201cunenforceable.\u201d The judge also ordered MV Realty to clear the memoranda, although some homeowners say they did not immediately see relief.\u00a0<\/p>\n<p>\u201cThey&#8217;re still holding $12,000 of mine, almost $13,000 \u2014 $12,700 to be exact,\u201d Raleigh Chapman told 10 Investigates last April.\u00a0<\/p>\n<p>RELATED |\u00a0<a href=\"https:\/\/www.wtsp.com\/article\/news\/investigations\/10-investigates\/mv-realty-ends-40-year-contracts-florida\/67-03eae322-db6a-4ac4-a67c-d6d09685e4cd\" class=\"cms__embed-related-story__link\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">MV Realty clears controversial 40-year contracts for all Florida homeowners, state says<\/a><\/p>\n<p>Vivian Lopez, who testified in the case and spoke exclusively to 10 Investigates, says she was forced to pay MV Realty more than $16,000 after choosing a different realtor.\u00a0<\/p>\n<p>She\u2019s one of more than 9,000 homeowners across the state who signed HBAs with MV Realty. She told 10 Investigates she hopes the state will share the $3 million settlement with homeowners who lost money in dealing with the company.\u00a0<\/p>\n<p>\u201cI&#8217;m hoping everybody gets their money back,\u201d she said.\u00a0<\/p>\n<p>10 Investigates asked the attorney general\u2019s office how restitution would work if MV Realty made its June 30 deadline. The office did not immediately respond to our request. However, some are not optimistic about repayment.<\/p>\n<p>RELATED | <a href=\"https:\/\/www.wtsp.com\/article\/news\/investigations\/10-investigates\/hillsborough-county-judge-rules-against-mv-realty-florida-real-estate-company\/67-b11c5d86-e8b4-45d4-b699-10f5b7036d38\" class=\"cms__embed-related-story__link\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Hillsborough County judge rules against MV Realty, calls 40-year contracts \u2018unconscionable\u2019<\/a><\/p>\n<p>\u201cI think homeowners typically wouldn&#8217;t see any money at all\u201d said attorney Charles Gallagher. \u201cIf there is a scenario where they don&#8217;t comply with a $3 million stipulated damages judgment and there&#8217;s the increased amount of the $18 million later, potentially there could be some amount of that to consumers, but I would have no expectations on seeing a dollar if I&#8217;m a consumer.&#8221;<\/p>\n<p>Still, there are positives for impacted homeowners, Gallagher said.\u00a0<\/p>\n<p>\u201cThe true win is having that document that&#8217;s really hijacked your property now for years probably, having that removed from the public record, being able to sell your home, being able to mortgage it, being able to encumber it,\u201d he said.\u00a0<\/p>\n<p>Legal experts also say this new court ruling sets a strong precedent for preventing other bad actors from harming homeowners and the assets they\u2019ve worked so hard to protect.\u00a0<\/p>\n<p>Emerald Morrow is an investigative reporter with\u00a010 Tampa Bay News.
