TALLAHASSEE, Fla. (WCTV) – A judge has dismissed a lawsuit filed by Florida A&M University students and alumni last June<\/a> that alleged the HBCU\u2019s search for a president was \u201cpredetermined in violation of the state Constitution.\u201d <\/p>\n

The complaint\u00a0asked for an emergency injunction<\/a> on behalf of 10 plaintiffs, a mixture of FAMU alumni and students, against eight FAMU Board of Trustees members who voted for Marva Johnson and the Florida BOG, including its chair, Brian Lamb, and vice chair, Alan Levine.<\/p>\n

On Tuesday afternoon, Judge Michael Beato dismissed the lawsuit.<\/p>\n

\u201cThe plaintiffs lack standing to sue. Even if there\u2019s standing, the plaintiffs failed to establish their request for mandatory injunctive relief and failed to establish their breach of fiduciary duties claim,\u201d the judge said. <\/p>\n
