{"id":153464,"date":"2026-02-12T20:32:12","date_gmt":"2026-02-12T20:32:12","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/153464\/"},"modified":"2026-02-12T20:32:12","modified_gmt":"2026-02-12T20:32:12","slug":"danny-nix-takes-aim-at-minimum-lot-sizes-with-florida-starter-homes-act","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/153464\/","title":{"rendered":"Danny Nix takes aim at minimum lot sizes with Florida Starter Homes Act"},"content":{"rendered":"<p style=\"text-align: justify;\">A proposal by Port Charlotte Republican Rep. <a href=\"https:\/\/floridapolitics.com\/archives\/tag\/danny-nix-jr\/\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Danny Nix<\/a> to ease local zoning rules to spur construction of smaller, more affordable homes has cleared its first House Committee.<\/p>\n<p style=\"text-align: justify;\">The <a href=\"https:\/\/www.flhouse.gov\/Sections\/Committees\/committeesdetail.aspx?CommitteeId=3304\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">House Intergovernmental Affairs Subcommittee<\/a> advanced <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/1143\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">HB 1143<\/a>, titled the \u201cFlorida Starter Homes Act,\u201d on a 14-2 vote following debate over local control, infrastructure capacity and housing affordability.<\/p>\n<p style=\"text-align: justify;\">HB 1143 would bar local governments from requiring minimum lot sizes larger than 1,200 square feet for residential properties connected to public water and sewer, while also limiting their ability to impose stricter setback, height, density and parking requirements.<\/p>\n<p style=\"text-align: justify;\">Under the proposal, local governments also would face accelerated timelines for reviewing development permit applications, with some applications deemed approved if officials fail to act within specified time frames.<\/p>\n<p style=\"text-align: justify;\">Nix told Committee members Thursday the legislation is designed to increase the supply of entry-level housing by allowing developers to build smaller and more affordable homes on smaller properties. He said the bill would apply in counties with at least 500 residents per square mile, of which there are currently 16.<\/p>\n<p><a href=\"https:\/\/www.hklaw.com\/en\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-653648\" src=\"https:\/\/www.newsbeep.com\/us-fl\/wp-content\/uploads\/2025\/10\/Influence_FGAT_Banner_728x90.jpg\" alt=\"\" width=\"728\" height=\"90\"\/><\/a><\/p>\n<p style=\"text-align: justify;\">\u201cLast year, only 20% of Florida\u2019s working-class households could afford to buy a starter home,\u201d Nix said. \u201cIn 2012, that was 74% who could. Land basis cost, as a Realtor I know, is what creates a divide and a gap that comes into these properties.\u201d<\/p>\n<p style=\"text-align: justify;\">Avery Bernstein, a 21-year-old college student from Gainesville who said he helped draft the measure, said minimum lot size requirements often make smaller homes effectively illegal. Bernstein pointed to Houston\u2019s minimum lot size reforms as a model, saying similar policies in Texas have resulted in thousands of smaller, more affordable homes being built.<\/p>\n<p style=\"text-align: justify;\">\u201cWhen a developer buys a large and expensive lot, they\u2019re only going to build a large and expensive home the vast majority of the time,\u201d Bernstein said. \u201cSince starter homes need a smaller lot to be developed, many local governments are actually making these starter homes illegal.\u201d<\/p>\n<p style=\"text-align: justify;\">The Florida League of Cities opposed the proposal, warning the bill could override local comprehensive plans and strain infrastructure. Florida League of Cities Deputy General Counsel <a href=\"https:\/\/www.flcities.com\/policy-committees\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">Rebecca O\u2019Hara<\/a> said the measure could allow dense development in areas without adequate planning safeguards and lacks assurances that homes built would be affordable.<\/p>\n<p style=\"text-align: justify;\">\u201cWhat will result from this is premature development of land at the edges of towns subsidized by existing taxpayers because concurrency \u2026 is notably absent from this bill,\u201d O\u2019Hara said. \u201cWater and sewer connections may be there for a lot today, but adding eight homes to that same lot and doing that multiple times will quickly overwhelm existing water and sewer capacity because that is not what has been planned for.\u201d<\/p>\n<p><a href=\"http:\/\/ncf.edu\/\" target=\"_blank\" rel=\"noopener external noreferrer nofollow\" data-wpel-link=\"external\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-722105 size-full\" src=\"https:\/\/www.newsbeep.com\/us-fl\/wp-content\/uploads\/2025\/10\/Sunburn_FloridaPoliticsWebsite_728x905186-scaled-e1740018793631.jpg\" alt=\"\" width=\"728\" height=\"90\"\/><\/a><\/p>\n<p style=\"text-align: justify;\">Orlando Democratic Rep. <a href=\"https:\/\/floridapolitics.com\/archives\/tag\/rita-harris\/\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Rita Harris<\/a>\u00a0raised concerns that the bill could unintentionally spur growth in areas not equipped to handle it, particularly in counties with residents who vocally defend established rural boundaries. Still, she voted to advance the measure, saying she expects continued work with local governments as it moves forward.<\/p>\n<p style=\"text-align: justify;\">\u201cIn my county, Orange County, we have a rural boundary,\u201d Harris said. \u201cPeople are very, very protective of that rural boundary. So I would like to see some more protections around those counties that have that in statute or ordinances around it to ensure that there will not be growth in those spaces because the communities have worked really hard to ensure that those areas stay pristine.\u201d<\/p>\n<p style=\"text-align: justify;\">Nix acknowledged that the bill remains a work in progress, but said it would help address Florida\u2019s affordable housing crisis if approved.<\/p>\n<p style=\"text-align: justify;\">\u201cThis bill has come a long way from where it was at, but the bill is still not perfect, we get that,\u201d he said. \u201cWe are definitely looking forward to having conversations to see the direction that\u2019s going to put this in a posture that\u2019s really good for Floridians.\u201d<\/p>\n<p style=\"text-align: justify;\">HB 1143 now heads to the Housing, Agriculture &amp; Tourism Subcommittee for its second of three Committee stops. A comparable bill (<a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/948\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">SB 948<\/a>) filed by Ocala Republican Sen. <a href=\"https:\/\/floridapolitics.com\/archives\/tag\/stan-mcclain\/\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Stan McClain<\/a> has cleared its first Senate Committee.
