{"id":174510,"date":"2026-03-02T02:18:20","date_gmt":"2026-03-02T02:18:20","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/174510\/"},"modified":"2026-03-02T02:18:20","modified_gmt":"2026-03-02T02:18:20","slug":"florida-moves-to-require-disclosure-on-new-data-center-locations","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/174510\/","title":{"rendered":"Florida moves to require disclosure on new data center locations"},"content":{"rendered":"<p>Feb. 27, 2026, 3:21 p.m. ET<\/p>\n<p>A Florida bill would mandate public disclosure of potential data center projects in communities.The legislation aims to address concerns over data centers straining local power and water supplies.The bill reduces the time developers can keep data center plans exempt from public records.<\/p>\n<p class=\"gnt_ar_b_p\">Public disclosure of whether a data center may be coming into a community would be mandated under a Florida bill, which cleared the Senate floor unanimously Feb. 26.<\/p>\n<p class=\"gnt_ar_b_p\">It&#8217;s part of Florida\u2019s overall push to <a href=\"http:\/\/www.tallahassee.com\/videos\/news\/state\/2026\/02\/25\/florida-house-advances-stricter-data-center-rules\/88868272007\/\" data-t-l=\":b|e|k|\u2691u\" class=\"gnt_ar_b_a\" rel=\"nofollow noopener\" target=\"_blank\">regulate data centers<\/a>, and it was introduced in an amendment in response to rising concerns that the public won\u2019t know whether a data center was being planned for near them.<\/p>\n<p class=\"gnt_ar_b_p\">Additionally, a revision presented by bill sponsor Sen. Bryan Avila also removed a developer\u2019s capability to extend a public records exemption to development plans for <a href=\"http:\/\/www.tallahassee.com\/story\/news\/local\/2025\/12\/15\/what-a-data-center-is-and-how-it-works-explained\/87675393007\/\" data-t-l=\":b|e|k|\u2691u\" class=\"gnt_ar_b_a\" rel=\"nofollow noopener\" target=\"_blank\">data centers<\/a>, facilities storing digital traffic with computer services, storage systems and equipment.<\/p>\n<p class=\"gnt_ar_b_p\">Opponents argue that large-scale data centers can strain local power grids and water supplies, drive up utility costs, generate noise and environmental impacts, and offer limited long-term economic benefits relative to the resources they consume. Here&#8217;s what it does, why it matters<\/a><\/p>\n<p class=\"gnt_ar_b_p\">Under existing Florida law, businesses could request a 12-month public records exemption for their plans or interests in expansion or construction. Although the measure still allows data center developers to request this exemption, the amendment removed the developer&#8217;s capability to seek an additional 12-month exemption from public records, for a total of two years.<\/p>\n<p><img class=\"gnt_em_img_i\" style=\"height:440px\" fetchpriority=\"high\" data-g-r=\"lazy\" data-gl-src=\"https:\/\/www.newsbeep.com\/us-fl\/wp-content\/uploads\/2026\/03\/81374809007-2025-opening-day-of-session-205.JPG\" data-gl- decoding=\"async\" alt=\"Sen. Bryan Avila listens to Senate President Ben Albritton speak during opening day of the Florida legislative session on Tuesday, March 4, 2025.\"\/><\/p>\n<p class=\"gnt_ar_b_p\">But the community won&#8217;t know the exact location based on this change to the bill, Avila said on the Senate floor. &#8220;There is only a 12-month period, and after that, that&#8217;s where certainly the particulars would be public knowledge at that point,&#8221; Avila said.<\/p>\n<p class=\"gnt_ar_b_p\">The bill (<a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/484\/?Tab=Amendments\" data-t-l=\":b|z|k|\u2691u\" class=\"gnt_ar_b_a\" rel=\"nofollow noopener\" target=\"_blank\">SB 484<\/a>) comes at a time when Republicans across the country are seeking to <a href=\"http:\/\/www.tallahassee.com\/story\/news\/state\/2026\/02\/25\/child-safety-vs-free-speech-rights-at-issue-in-florida-ai-bill\/88669010007\/\" data-t-l=\":b|e|k|\u2691u\" class=\"gnt_ar_b_a\" rel=\"nofollow noopener\" target=\"_blank\">regulate artificial intelligence<\/a> and data centers, and are sometimes split on whether the state should be handling its regulations versus the federal government under President Donald Trump \u2013 which <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/12\/eliminating-state-law-obstruction-of-national-artificial-intelligence-policy\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" data-t-l=\":b|z|k|\u2691u\" class=\"gnt_ar_b_a\">seeks to support its growth<\/a> rather than stifle it with legislation.\u00a0<\/p>\n<p class=\"gnt_ar_b_p\">State policymakers want to ensure Florida residents wouldn\u2019t be responsible for utility costs racked up by the artificial intelligence data centers. The overarching measure <a href=\"http:\/\/www.tallahassee.com\/story\/news\/state\/2026\/02\/27\/florida-legislative-session-desantis-agenda-stalls\/88865999007\/\" data-t-l=\":b|e|k|\u2691u\" class=\"gnt_ar_b_a\" rel=\"nofollow noopener\" target=\"_blank\">backed by Gov. Ron DeSantis<\/a> to regulate AI data centers is gradually gaining more momentum through the Legislature; its House companion (<a href=\"https:\/\/www.flhouse.gov\/Sections\/Bills\/billsdetail.aspx?BillId=83648\" data-t-l=\":b|z|k|\u2691u\" class=\"gnt_ar_b_a\" rel=\"nofollow noopener\" target=\"_blank\">HB 1007<\/a>) had lagged for weeks but recently started sweeping through committees.\u00a0Although this data center proposal is moving largely with bipartisan support among Florida lawmakers, the policy is <a href=\"http:\/\/www.tallahassee.com\/story\/news\/state\/2026\/02\/24\/florida-defying-trump-on-data-center-regulations\/88839310007\/\" data-t-l=\":b|e|k|\u2691u\" class=\"gnt_ar_b_a\" rel=\"nofollow noopener\" target=\"_blank\">staunchly opposed by Trump<\/a>, who wants only the <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/07\/accelerating-federal-permitting-of-data-center-infrastructure\/\" data-t-l=\":b|z|k|\u2691u\" class=\"gnt_ar_b_a\" rel=\"nofollow noopener\" target=\"_blank\">feds to regulate data centers<\/a>.\u00a0<\/p>\n<p class=\"gnt_ar_b_p\">Another bill linked to the data centers regulation is SB 1118, which specifically ensures that the plans, interests and intentions for locating data centers are exempt from public records. Avila&#8217;s office did not return a request for comment on how the amendment may affect public records exemptions.<\/p>\n<p>Why is data center construction relevant in Florida?<\/p>\n<p class=\"gnt_ar_b_p\">Florida has more than 100 data centers, with developers continually looking across the state to enter its market.<\/p>\n<p class=\"gnt_ar_b_p\">One particular project, known as Project Tango, has faced outrage from Palm Beach County residents. The proposed legislation would bar most data centers from being built near homes and schools.<\/p>\n<p class=\"gnt_ar_b_p\">This reporting content is supported by a partnership with Freedom Forum and Journalism Funding Partners.
