Ocner<\/p>\n<p>            mocner@miamiherald.com<\/p>\n<p>Miami prosecutors appealed a judge\u2019s order granting a new murder trial for an inmate who made national headlines when she became pregnant while behind bars.<\/p>\n<p>Miami-Dade Circuit Court Judge Lody Jean granted Daisy Link, 30, a new trial because Link was \u201cprejudiced\u201d by photos that prosecutors showed jurors \u2014 hoping to discredit her self-defense claim \u2014 despite the photographs not being introduced as evidence, according to an order filed in court. Jean presided over the trial.<\/p>\n<p>Prosecutors appealed Jean\u2019s order to the Third District Court of Appeal, according to a document filed in court on Friday.<\/p>\n<p>In October, a jury convicted Link of second-degree murder for killing her husband, Pedro Jimenez, 33, outside her Homestead residence in June 2022. Link shot Jimenez once in the leg.<\/p>\n<p><a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.miamiherald.com\/news\/local\/crime\/article312534045.html\">READ MORE: Woman went viral for mystery jailhouse pregnancy. She\u2019s guilty of murder: Miami jury<\/a><\/p>\n<p>During a hearing on Monday morning, Jean also stayed, or paused, any proceedings, including a trial, at prosecutors\u2019 request. That means Link\u2019s trial will not start until the appellate court issues an opinion on the case.<\/p>\n<p>It could take a year or two for the appeals court to hear the appeal in Link\u2019s case, Jean said. Ocner                                                                            mocner@miamiherald.com                                                                                        <\/p>\n<p>In January, Link was accused of <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.miamiherald.com\/news\/local\/crime\/article314471684.html\">entering another inmate\u2019s jail cell and punching her in the face<\/a>. During Monday\u2019s proceeding, Jean set a hearing in that case for March 9.<\/p>\n<p>Why was Link granted new trial?<\/p>\n<p>During closing arguments, prosecutors used the four photographs at the center of the controversy to discredit the testimony of Link\u2019s mother, the order says. The photos showed Link\u2019s home with no broken windows or damage. However, Link\u2019s mother testified that Jimenez had broken into Link\u2019s house through a window.<\/p>\n<p><a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.miamiherald.com\/news\/local\/crime\/article314592858.html\">READ MORE: Woman who made headlines for jailhouse pregnancy granted new murder trial<\/a><\/p>\n<p>In her order, Jean said \u201cthe errors deprive of a fair and impartial trial and likely materially contributed to the jury\u2019s finding of guilty.\u201d<\/p>\n<p>\u201c[The photos] came at a critical time in the trial, during the closing argument which was almost impossible to rebut &#8230;,\u201d Jean said. \u201cNot only was un-admitted evidence presented to the jury, but it was also coupled with argument used directly to discredit [Link\u2019s] self-defense claims [from] a key witness in the case \u2014 [Link\u2019s] mother.\u201d<\/p>\n<p>                                                                                                                                                                                                              <img class=\"responsive-image\" width=\"1140\" height=\"758\"  alt=\"Daisy Link appears in a hearing for a new trial at the Richard E. Ocner                                                                            mocner@miamiherald.com                                                                                        <\/p>\n<p>Link\u2019s defense attorney claimed she acted in self-defense when she shot Jimenez, who was her husband of nine years and had allegedly brutally beat her days before the killing. Prosecutors, however, painted a drastically different picture of the murder, alleging that Link killed her husband because she wanted to end their relationship.<\/p>\n<p>During her trial, Link took the stand in her own defense, testifying about the moments leading up to the shooting. Jimenez, she said, grabbed her by the hair and threw her to the ground in a drug-fueled rage over infidelity.<\/p>\n<p>\u201cI took a shot. I initially aimed towards the floor as I lifted the gun,\u201d Link said on the stand. \u201cI didn\u2019t expect it to hit him. In June 2024, she gave birth to a daughter, conceived by Link and inmate Joan DePaz after Link inseminated herself with DePaz\u2019s sperm, which was passed through an air vent.
