Here\u2019s what to know"},"content":{"rendered":"<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">TALLAHASSEE, Fla. \u2013 A new bill filed in Florida back in January aimed to lay out a litany of rules for mobile home parks in the state \u2014 but its time is running out.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The bill (<a href=\"https:\/\/www.flhouse.gov\/Sections\/Bills\/billsdetail.aspx?BillId=83327&amp;SessionId=113\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.flhouse.gov\/Sections\/Bills\/billsdetail.aspx?BillId=83327&amp;SessionId=113\">HB 703<\/a>) was originally filed back in December by state Rep. Paula Stark (R-St. Cloud), and it amends a <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0723\/Sections\/0723.033.html\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0723\/Sections\/0723.033.html\">Florida statute<\/a> that governs what factors courts may use to determine whether rent increases are \u201cunreasonable.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Under current law, courts may take factors like prior disclosures, inflation changes, operating costs and taxes into account.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">However, this latest bill would expand the law to let courts also consider the following factors:<\/p>\n<p>The number of active sales within a mobile home park at the time the notice of rent increase is issued<\/p>\n<p>Incentives and other discounts being offered to new purchasers by the mobile home park owner or the mobile home owner<\/p>\n<p>The number of mobile homes abandoned to the park owner in the previous 12 months for the purpose of avoiding eviction<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">But that\u2019s not all. The bill also introduces some key rules for mobile home park owners to keep in mind.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">[BELOW: Florida mobile home parks are getting expensive, but not for residents who do this thing]<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">For example, if a mobile home owner is unable to pay his\/her rent, he\/she would have a 10-day window after receiving notice to pay up. That timeframe is twice what the current law allows.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Other new rules introduced by the legislation are as follows:<\/p>\n<p>Payment Methods: Park owners may not require mobile home owners to use an electronic payment system as the only method to pay rent or user fees.<\/p>\n<p>Rent Increases: If there is a proposed increase in lot rent, all relevant invoices, evidence or proof that shows the expenses or material factors behind the increase must be included in such notice.<\/p>\n<p>Rent Reductions: If an amenity, service or utility is no longer available to mobile home owners, the park owner must reduce their rent.<\/p>\n<p>Land-Use Payouts: If a mobile home owner is required to move due to <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0700-0799%2F0723%2FSections%2F0723.061.html\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0700-0799%2F0723%2FSections%2F0723.061.html\">a change in the land-use for the park<\/a>, the owner is entitled to compensation for moving expenses and $6,500 from the state (or $11,500 for a multi-section mobile home).<\/p>\n<p>This is up from the current state law, which puts that figure at $3,000 (or $6,000 for a multi-section mobile home).<\/p>\n<p>Abandonment Payouts: In lieu of accepting payment after a land-use change, a mobile home owner may instead abandon the home and collect $5,000 from the state (or $7,000 for a multi-section mobile home).<\/p>\n<p>This is up from the current state law, which puts that figure at $1,375 (or $2,750 for a multi-section mobile home).<\/p>\n<p>If this option is selected, the park owner must pay the state $1,375 for a single-section mobile home, and $2,750 for a multi-section mobile home.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">[BELOW: Who polices mobile home registrations?]<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">If approved, the bill is set to take effect on July 1.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">However, the latest Legislative session is set to end on Thursday, and HB 703 hasn\u2019t even passed a single committee yet. As such, it seems unlikely that the bill will end up being approved.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Regardless, Rep. Stark provided News 6 with the following statement in January about her proposed legislation:<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 ewwUYq\">\u201cI\u2019ve filed HB 703 \u2013 Mobile Home Park Lot Tenancies, legislation to strengthen protections and clarify the rights of mobile home owners across Florida. This bill updates how lot rental increases are determined, improves billing and payment transparency, and enhances enforcement&#8230; Mobile home owners are a critical part of our communities, and this bill helps ensure fairness and accountability in lot tenancies.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 ewwUYq\">This should be a bipartisan issue for the benefit of all of our citizens who need to maintain the opportunity of affordable housing.\u201d<\/p>\n<p>Florida State Rep.
