This would improve transparency in Florida\u2019s state government, but I\u2019d argue it doesn\u2019t go far enough. Other states, such as Ohio, Pennsylvania and Connecticut, have implemented stronger laws, including <a href=\"https:\/\/journals.flvc.org\/civic\/article\/view\/140505\/145597\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:independent enforcement of their sunshine laws;elm:context_link;itc:0;sec:content-canvas\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;independent enforcement of their sunshine laws&quot;}\" class=\"link \">independent enforcement of their sunshine laws<\/a>, to ensure their governments comply.<\/p>\n<p>It starts at the top<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">State and local governments appear to be taking their cues from the federal government.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">President Donald Trump\u2019s administration heralds itself as the <a href=\"https:\/\/www.whitehouse.gov\/videos\/presssec-president-trump-is-truly-the-most-transparent-accessible-president-in-american-history\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:most transparent in history;elm:context_link;itc:0;sec:content-canvas\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;most transparent in history&quot;}\" class=\"link \">most transparent in history<\/a>, pointing to the president\u2019s willingness to talk informally to the press or directly to the public through social media.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">While that may be one definition of transparency, the federal government\u2019s willingness to provide documents that show what the government is doing \u2013 not just what it says it is doing \u2013 has been eviscerated under the second Trump administration. Examples include:<\/p>\n<p><img alt=\"US Capitol pictured through the bars of a fence\" loading=\"lazy\" width=\"960\" height=\"640\" decoding=\"async\" data-nimg=\"1\" class=\"rounded-lg\" style=\"color:transparent\" src=\"https:\/\/www.newsbeep.com\/us-fl\/wp-content\/uploads\/2026\/03\/e18c53d5550ee52f3ca6353307ee508f.jpeg\"\/><\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Typically, the Department of Justice <a href=\"https:\/\/www.justice.gov\/oip\/annual-foia-reports-fy25\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:releases annual statistics;elm:context_link;itc:0;sec:content-canvas\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;releases annual statistics&quot;}\" class=\"link \">releases annual statistics<\/a> on FOIA requests every March. When I examined initial reports posted in January, when just 11 agencies had provided their reports, backlogs \u2013 that is, requests that remain unresolved after a year \u2013 had increased 67% from the previous fiscal year. The time to process simple requests nearly doubled.<\/p>\n<p>Plummeting to historical depths<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In order to understand how secrecy in the United States now compares to historical precedent, I reached out to people who have researched freedom of information for decades, some going back to the 1970s.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">I asked them a simple question: How does the current state of affairs in freedom of information compare historically?<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Here is what they told me:<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\"><a href=\"https:\/\/law.umn.edu\/profiles\/jane-kirtley\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Jane Kirtley;elm:context_link;itc:0;sec:content-canvas\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;Jane Kirtley&quot;}\" class=\"link \">Jane Kirtley<\/a> is a longtime FOIA scholar from the University of Minnesota who <a href=\"https:\/\/doi.org\/10.1207\/s15326926clp1104_2\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:wrote in 2006;elm:context_link;itc:0;sec:content-canvas\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;wrote in 2006&quot;}\" class=\"link \">wrote in 2006<\/a>, \u201cThe Bush administration\u2019s contempt for the public\u2019s right to know amounts to an organized assault on freedom of information that is unprecedented since the enactment of the Freedom of Information Act 40 years ago.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Today, in comparison? \u201cAbysmal,\u201d she wrote to me via email. \u201cIt was abundantly clear from the moment Elon Musk and his \u2018musketeers\u2019 invaded and pillaged government electronic records that we have entered a new era of deletion, obfuscation, fabrication and utter contempt for the concept of data integrity and the public\u2019s right to know.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\"><a href=\"https:\/\/www.americanbar.org\/advocacy\/global-programs\/who-we-are\/staff\/profiles\/susman-t\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Thomas Susman;elm:context_link;itc:0;sec:content-canvas\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;Thomas Susman&quot;}\" class=\"link \">Thomas Susman<\/a>, who helped craft the 1974 FOIA amendments and currently assists the American Bar Association, <a href=\"https:\/\/web.archive.org\/web\/20050406194156\/http:\/www.opengovjournal.org\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:wrote in 2005;elm:context_link;itc:0;sec:content-canvas\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;wrote in 2005&quot;}\" class=\"link \">wrote in 2005<\/a> that increasing delays and backlogs threatened FOIA\u2019s intended purpose.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In February 2026, he wrote to me that the \u201carc of the FOIA universe has for six decades bent toward greater public access to government information \u2212 until now. If \u2018democracy dies in darkness\u2019 (according to The Washington Post\u2019s official slogan), America\u2019s democracy is threatened with becoming dead meat. We\u2019ve survived the Civil War, the Great Depression, Vietnam, Watergate and more.
