{"id":201150,"date":"2026-03-22T06:53:34","date_gmt":"2026-03-22T06:53:34","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/201150\/"},"modified":"2026-03-22T06:53:34","modified_gmt":"2026-03-22T06:53:34","slug":"boys-12-and-13-back-in-court-as-judge-decides-on-detention-in-overtown-child-rape-case","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/201150\/","title":{"rendered":"Boys, 12 and 13, back in court as judge decides on detention in Overtown child rape case"},"content":{"rendered":"<p class=\"c-paragraph\">MIAMI \u2014 Two of the three young boys being charged as adults after being accused of <a href=\"https:\/\/www.local10.com\/news\/local\/2026\/02\/27\/boys-12-and-13-charged-as-adults-in-overtown-rape-of-12-year-old-girl-police-say\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.local10.com\/news\/local\/2026\/02\/27\/boys-12-and-13-charged-as-adults-in-overtown-rape-of-12-year-old-girl-police-say\/\">raping a 12-year-old girl<\/a> in Miami\u2019s Overtown neighborhood were back in court Thursday as a <a href=\"https:\/\/www.local10.com\/news\/local\/2026\/03\/18\/judge-to-rule-whether-miami-boys-accused-of-brutal-half-hour-rape-of-12-year-old-stay-jailed\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.local10.com\/news\/local\/2026\/03\/18\/judge-to-rule-whether-miami-boys-accused-of-brutal-half-hour-rape-of-12-year-old-stay-jailed\/\">judge weighs<\/a> whether they should stay locked up. <\/p>\n<p class=\"c-paragraph\"><a href=\"https:\/\/www.local10.com\/espanol\/2026\/03\/20\/menores-de-12-y-13-anos-vuelven-a-corte-mientras-juez-decide-sobre-detencion-en-caso-de-violacion-infantil-en-overtown\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.local10.com\/espanol\/2026\/03\/20\/menores-de-12-y-13-anos-vuelven-a-corte-mientras-juez-decide-sobre-detencion-en-caso-de-violacion-infantil-en-overtown\/\">Leer en espa\u00f1ol<\/a><\/p>\n<p class=\"c-paragraph\">Miami-Dade Judge Richard Hersch continued to hear arguments for and against keeping Nelson Nunez, 13, and Jusiah Jones, 12, locked up until their trials during a pre-trial detention \u201cArthur hearing.\u201d<\/p>\n<p class=\"c-paragraph\">In such a hearing, a judge decides if a suspect or suspects could be released on bond, even though they\u2019re charged with offenses that would typically keep someone behind bars.<\/p>\n<p class=\"c-paragraph\">Nunez and Jones, along with then-14-year-old Xavier Tyson, are accused of raping the girl on June 18 at The Green Haven Project community garden, located at 1160 NW Second Ave., near Frederick Douglass Elementary School.<\/p>\n<p class=\"c-paragraph\">Jones is accused of putting rocks in the girl\u2019s mouth during the assault, which she said lasted about a half-hour, to keep her quiet.<\/p>\n<p class=\"c-paragraph\">Tyson, now 15, is not in custody but will have his own pre-trial detention hearing soon.<\/p>\n<p class=\"c-paragraph\">Bijan Sebastian Parwaresch, Nunez\u2019s attorney, argued, \u201cClearly, at that age, the understanding of inactions and the consequences are not the same as an adult person,\u201d as he argued that his client should be released on bond.<\/p>\n<p class=\"c-paragraph\">Miami Police Department Detective Louis Joseph, the lead investigator on the case, faced questions related to the young victim\u2019s statement.<\/p>\n<p class=\"c-paragraph\">Jones was emotional in the courtroom as a detective recounted the victim\u2019s statement.<\/p>\n<p class=\"c-paragraph\">\u201cIn your report, (you said Jusiah Jones) told Nelson Nunez and Xavier Tyson that \u2018they were going too far\u2019 and \u2018they\u2019 is Nelson Nunez and Xavier Tyson, correct?\u201d Jones\u2019 attorney asked Joseph.<\/p>\n<p class=\"c-paragraph\">\u201cCorrect,\u201d Joseph replied.<\/p>\n<p class=\"c-paragraph\">A forensic psychologist also testified to the possible impact of housing a child in an adult jail.<\/p>\n<p class=\"c-paragraph\">\u201cIn general, my concern would be that you have somebody who is not just a juvenile, but quite young, who would inherently need to be segregated from their general population that they serve,\u201d Dr. Heather Holmes testified.<\/p>\n<p class=\"c-paragraph\">The ongoing hearing is set to resume on Monday morning.<\/p>\n<p>\ud83c\udfe0 News From Your Neighborhood<\/p>\n<p class=\"c-paragraph b-article-body__copyright\">Copyright 2026 by WPLG Local10.com &#8211;
