(WPLG) <\/p>\n<p class=\"c-paragraph\">MIAMI \u2014 A judge granted class action status to plaintiffs in a <a href=\"https:\/\/www.local10.com\/news\/local\/2026\/03\/11\/coconut-grove-residents-suing-city-over-infamous-old-smokey-incinerator-an-injustice-was-done\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.local10.com\/news\/local\/2026\/03\/11\/coconut-grove-residents-suing-city-over-infamous-old-smokey-incinerator-an-injustice-was-done\/\">toxic exposure lawsuit<\/a> over a former incinerator in Miami\u2019s Coconut Grove neighborhood, attorneys for the plaintiffs announced Monday morning.<\/p>\n<p class=\"c-paragraph\">The lawsuit, filed against against the city of Miami, alleges that residents in the historically-Black West Grove section were exposed to cancer-causing ash from an incinerator that operated there for more than 40 years, known infamously as \u201cOld Smokey.\u201d<\/p>\n<p class=\"c-paragraph\">It was located at 3425 Jefferson St. and currently houses a training facility for Miami Fire Rescue.<\/p>\n<p class=\"c-paragraph\">According to the firm representing the plaintiffs, the judge certified a class \u201cencompassing approximately 2,220 residential properties across Coconut Grove and Coral Gables that are alleged to have been contaminated by ash and emissions from the Old Smokey incinerator.\u201d<\/p>\n<p class=\"c-paragraph\">\u201cAs part of the certification process, all identified properties will receive mailed notices informing owners and residents of their potential eligibility, as required under class action procedures,\u201d a news release from the plaintiffs states.<\/p>\n<p class=\"c-paragraph\">The plaintiffs state they are seeking medical monitoring for early detection of cancer and other illnesses and compensation for property damage caused by contamination.<\/p>\n<p class=\"c-paragraph\">Lawyers representing the city have tried to have the suit dismissed.<\/p>\n<p class=\"c-paragraph\">Local 10 News has contacted the city seeking comment on the case.<\/p>\n<p>\ud83c\udfe0 News From Your Neighborhood<\/p>\n<p class=\"c-paragraph b-article-body__copyright\">Copyright 2026 by WPLG Local10.com &#8211; All rights reserved.<\/p>\n<p><img decoding=\"async\" data-chromatic=\"ignore\" alt=\"Chris Gothner\" class=\"c-image\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/us-fl\/wp-content\/uploads\/2026\/03\/https:\/\/author-service-images-sandbox-us-east-1.publishing.aws.arc.pub\/wplginc\/3be3b5ed-fb4b-43ce-8b.jpeg\"  width=\"100\" height=\"100\"\/>Chris Gothner <\/p>\n<p class=\"c-paragraph b-author-bio__author-description\">Chris Gothner joined the Local 10 News team in 2022 as a Digital Journalist.<\/p>\n","protected":false},"excerpt":{"rendered":"Published:\u00a0March 23, 2026 at 10:40 AM lead-art-block.fullscreen-enterExpandPhoto &#8220;Old Smokey&#8221; incinerator.
