{"id":212429,"date":"2026-03-31T01:10:24","date_gmt":"2026-03-31T01:10:24","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/212429\/"},"modified":"2026-03-31T01:10:24","modified_gmt":"2026-03-31T01:10:24","slug":"cardi-b-wins-victory-in-lawsuit-claiming-enough-miami-stole-beats","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/212429\/","title":{"rendered":"Cardi B Wins Victory in Lawsuit Claiming &#8216;Enough (Miami)&#8217; Stole Beats"},"content":{"rendered":"<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t<a href=\"https:\/\/www.rollingstone.com\/t\/cardi-b\/\" id=\"auto-tag_cardi-b\" data-tag=\"cardi-b\" rel=\"nofollow noopener\" target=\"_blank\">Cardi B<\/a> scored another court victory Monday when a federal judge in Texas dismissed <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/cardi-b-enough-miami-reservation-dogs-lawsuit-1235054189\/\" data-type=\"link\" data-id=\"https:\/\/www.rollingstone.com\/music\/music-news\/cardi-b-enough-miami-reservation-dogs-lawsuit-1235054189\/\" rel=\"nofollow noopener\" target=\"_blank\">the copyright infringement lawsuit<\/a> claiming her hit song \u201cEnough (Miami)\u201d stole beats from the 2021 song \u201cGreasy Frybread\u201d from the acclaimed FX series Reservation Dogs.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tPlaintiffs Joshua Fraustro and Miguel Aguilar, known professionally as the production duo Kemika1956, sued the Grammy-winning rapper nearly two years ago, claiming she violated the copyright for \u201cGreasy Frybread\u201d by \u201creproducing, distributing, and publicly performing the infringing work\u201d without permission. They later amended their complaint to add more claims, including defamation.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tCardi challenged the lawsuit on several grounds, including her argument that \u201cGreasy Frybread\u201d was not protected by copyright. Her lawyers said the plaintiffs initially brought a federal copyright infringement claim but later shifted to Texas law. \u201cIt appears this was done because [plaintiffs] belatedly realized \u2013 after [Cardi\u2019s] counsel brought it to their attention \u2013 that they lacked a copyright registration,\u201d Cardi\u2019s lawyers wrote in a dismissal motion filed in September 2024. The plaintiffs later secured a copyright for \u201cGreasy Frybread\u201d with an effective registration date of Oct. 31, 2025.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tIn his ruling Monday, U.S. District Judge Fernando Rodriguez concluded that Fraustro and Aguilar\u2019s state court claims were preempted by federal Copyright law. He said the duo did not have jurisdiction over Cardi in Texas to take advantage of any of the state laws there and that giving them another chance to amend their complaint would be \u201cfutile.\u201d <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tFraustro and Aguilar argued that Cardi, born Belcalis Alm\u00e1nzar, performed multiple shows in Texas. But the judge found that those appearances were no different from her performances in other states, and therefore insufficient to establish general jurisdiction. \u201cIn addition, even if personal jurisdiction existed, each of plaintiffs\u2019 causes of action would be subject to dismissal for failing to state a claim upon which relief can be granted,\u201d he wrote.<\/p>\n<p>\t\tEditor\u2019s picks<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cObviously, we are very pleased with today\u2019s order and appreciate the court\u2019s careful consideration of the issues,\u201d Cardi\u2019s longtime laywer, Lisa F. Moore, said in a statement sent to Rolling Stone. (Robert R. Flores, the lawyer for the plaintiffs, did not respond to a request for comment.)<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tIn 2021, Kemika1956 released the song \u201cGreasy Frybread\u201d with Sten Joddi, the actor who played rapper Punkin\u2019 Lusty on Reservation Dogs. The track has notched more than 920,000 views since <a href=\"https:\/\/www.youtube.com\/watch?v=UlSfJ6ZBbI8&amp;t=52s\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">it was uploaded<\/a> on FX Networks\u2019 YouTube four years ago.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tCardi\u2019s \u201cEnough (Miami),\u201d her first single as a solo artist and sans guests since 2021, has 78 million <a href=\"https:\/\/www.youtube.com\/watch?v=narFtb5tdTQ\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">views on YouTube<\/a> and reached Number Nine on the Billboard Hot 100.\u00a0The song was also named one of <a href=\"https:\/\/www.rollingstone.com\/music\/music-lists\/best-songs-of-2024-so-far-1235031994\/usher-feat-pheelz-ruin-1235032695\/\" rel=\"nofollow noopener\" target=\"_blank\">Rolling Stone\u2019s Best Songs of 2024<\/a>.<\/p>\n<p>\t\tTrending Stories<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tCardi\u2019s latest court win comes after a long line of legal victories. Last September, a jury rejected an assault lawsuit brought by a security guard against the \u201cWAP\u201d rapper, <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/cardi-b-trial-closing-arguments-1235419754\/\" rel=\"nofollow noopener\" target=\"_blank\">taking only an hour<\/a> to unanimously side with Cardi. She also previously scored\u00a0<a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/cardi-b-1-25-million-defamation-lawsuit-victory-tasha-k-1290026\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">a $4 million jury verdict<\/a>\u00a0against celebrity gossip vlogger Latasha Kebe, professionally known as Tasha K.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tMeanwhile, a New York judge sided with Cardi and\u00a0<a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/www.rollingstone.com\/music\/music-news\/cardi-b-libel-lawsuit-maga-hat-trump-flag-1327087\/\">dismissed a libel lawsuit<\/a>\u00a0that named her as a defendant alongside her sister, Hennessy.
